Judge Confirms San Diego School District Canโ€™t Proceed With Student COVID-19 Vaccine Mandate, Even During Appeal

@COVID19Up: A judge declared Monday (Jan. 17) night that San Diego Unified cannot implement its student COVID-19 vaccine mandate, even if the matter is under appeal.

The new judgment comes days after the school district announced apparent plans to require the COVID-19 vaccine of athletes and extracurricular participants.

The judgment is yet another victory for Let Them Choose, a North County-based organization that sued San Diego Unified last year challenging the districtโ€™s COVID-19 vaccine mandate for students age 16 and up. Last month, San Diego Superior Court Judge John Meyer sided with Let Them Choose and said school districts lack the legal authority to mandate vaccination on their own. Soon after, the school district announced it would appeal the ruling.

Meyer said in his new judgment that an appeal by the district will not pause his previous ruling, meaning the district is still prohibited from enforcing a COVID-19 vaccine mandate for students.

Steve Bannon Is on to Something and the NYT Is Worried: โ€˜Local Races Are the Ventilation Shaft in the Republican Death Starโ€™

In a recent cringe-filled left-stream article, the NYT focuses on the power of local elections and warns Dems that they need a Plan B as Republicans use the โ€œlocal action = national impactโ€ strategy to take back the country. Ezra Klein writes:

โ€œThis week, I half-jokingly asked Ben Wikler, the chairman of the Wisconsin Democratic Party, what it felt like to be on the front lines of protecting American democracy. He replied, dead serious, by telling me what it was like. He spends his days obsessing over mayoral races in 20,000-person towns, because those mayors appoint the city clerks who decide whether to pull the drop boxes for mail-in ballots and [itโ€™s] small changes to electoral administration that could be the difference between winning Senator Ron Johnsonโ€™s seat in 2022โ€ฆ and losing the race and the Senate. Wikler is organizing volunteers to staff phone banks to recruit people who believe in democracy to serve as municipal poll workers, because Steve Bannon has made it his mission to recruit people who donโ€™t believe in democracy to serve as municipal poll workers.

Iโ€™ll say this for the right: They pay attention to where the power lies in the American system, in ways the left sometimes doesnโ€™t. Bannon calls this โ€˜the precinct strategy,โ€™ and itโ€™s working. โ€˜Suddenly, people who had never before showed interest in party politics started calling the local G.O.P. headquarters or crowding into county conventions, eager to enlist as precinct officers,โ€™ ProPublica reports. โ€˜They showed up in states Trump won and in states he lost, in deep-red rural areas, in swing-voting suburbs and in populous cities.โ€™

โ€˜If you want to fight for the future of American democracy, you shouldnโ€™t spend all day talking about the future of American democracy,โ€™ Wikler said. โ€˜These local races that determine the mechanics of American democracy are the ventilation shaft in the Republican death star. These races get zero national attention. They hardly get local attention. Turnout is often lower than 20 percent. That means people who actually engage have a superpower.โ€™โ€
