DePerno Issues Legal Opinion Re State Legislature’s Authority to Recall Electors

The following is a legal opinion submitted to AZ State Senator Wendy Rogers by attorney Matt DePerno in response to her question: “Can a State Legislature recall the state electors to decertify a national election upon proof of fraud in the election?”

DePerno concludes that “The Answer is ‘Yes.’ […] A legislature’s determination to decertify the votes cast by the electors on demonstration of fraud in the election itself is nothing more than the Legislature’s use of its reserved sovereign powers under the Tenth Amendment to protect those fundamental rights and privileges reserved to the People by the Ninth Amendment.”

Update on Wisconsin Election Investigation by Speaker Vos - More Subpoenas Going Out Soon | War Room

Wisconsin has two Election audit tracks currently moving forward:

1) Rep Janel Brandtjen’s audit, which appears to follow the AZ model and,

2) Speaker Robin Vos’ “cyber forensic” investigation led by former Justice Mike Gableman.

It’s unclear whether Brandtjen and Vos are coordinating efforts.

In a statement Wednesday, Vos said: “We believe a cyber-forensic audit is necessary to ensure issues did not happen in 2020. We have allocated additional resources to Justice Gableman to ensure this investigation gets to the truth.”

Reince Priebus, who is close friends with Vos, joined War Room yesterday to offer an update on the Gableman investigation.

According to Priebus, the General Assembly has approved $680K to help fund the Vos/ Gableman audit. Dr. Shiva is expected to be involved, subpoenas will be issued within the next 2 weeks, and the team will focus on ballet harvesting, voter roll anomalies and verification, a forensic examination of the physical ballots, and a review of the 200K potentially illegal indefinitely confined ballots. Although Vos specifically referenced a ‘cyber-forensic audit,’ Priebus did not mention a voting equipment examination.

Vos appears to have had a change of heart after flying with President Trump to the Alabama rally last week. At a July 27th press conference, he was critical of Rep. Brandtjen’s efforts, saying, "my colleague, Representative Brandtjen, is misinformed about what we're doing in Wisconsin."

@COVID19Up: The FDA should demand that companies complete the two year follow-up, as originally planned (even without a placebo group), writes Peter Doshi, associate editor at The British Medical Journal and assistant professor of pharmaceutical health services at the University of Maryland.

Since COVID-19 vaccine efficacy wanes over time, the question becomes what level of effectiveness will it provide when a person is exposed to the virus? Unlike COVID-19 vaccines, influenza vaccine performance has always been judged over a full season, not a couple months.

The FDA should demand adequate, controlled studies using patient outcomes. Regulators should bolster public trust by ensuring everyone can access the data.
