Rising "Constitutional Carry" Is a Sign of Failing Trust in Government

Come next January, Alabama will be the twenty-fifth state to allow concealed carry without a permit. Alabama will soon join Indiana, which in March of this year passed a new statute allowing permitless concealed carry—sometimes called "constitutional carry." In 2021 alone, at least six states passed their own provisions legalizing permitless concealed carry: Arkansas, Iowa, Montana, Tennessee, Texas, and Utah. Essentially, any law-abiding citizen over a certain age (usually eighteen or twenty-one) can now carry a concealed firearm in these states. Twenty years ago, only Vermont allowed unrestricted concealed carry. Over the last ten years, however, more than twenty states have adopted new laws deregulating the carrying of firearms.

Why is this happening now? On the most simple level, these laws have passed because lawmakers and constituents at the state level have advocated for them. Moreover, whatever opposition exists among interest groups and the public has been insufficient to block their passage.

The Supreme Court in June struck down a New York law that effectively prohibited ordinary citizens from carrying handguns in public for self-defense.

As some New Yorkers joined gun control activists in decrying the decision as making them less safe, one young woman explained how, for her, the high court’s opinion meant she was one step closer to sleeping soundly for the first time in months.

Laura Adkins, a liberal journalist living in New York City, described how, after a recent breakup, her ex-partner’s increasingly obsessive and harassing behavior made her fear for her life despite the temporary order of protection she got.

For weeks, Adkins said, she slept with a sheathed hunting knife under her pillow, fully aware that it would offer little protection against a man twice her size, but knowing she had few other readily available options for defending herself given the city’s incredibly restrictive laws on handgun possession.

A good predictor that restrictive laws are on their way out is when large numbers of people honor them in the breach. Prohibition famously foundered on Americans' desire to keep the party going. Marijuana legalization gained acceptance as a large and growing segment of the U.S. population enjoyed its use despite government-imposed restrictions.

If this pattern holds, we should soon expect psychedelic drugs to overcome legal barriers. That won't just be a victory for people's freedom to make their own choices, but also for innovators who see therapeutic promise in LSD, magic mushrooms, and MDMA.
