There is currently considerable speculation regarding potential retirements from the Supreme Court during this current term. We remain committed to providing the most up-to-date information concerning any developments related to cases or Justices. At present, there is no indication that any of the nine Justices on the bench intend to retire. However, this situation may change, particularly within the next two months as the term concludes for the summer. Should any developments occur, please be assured that SCOTUS Focus will provide comprehensive coverage of it all.

We have our first and only opinion of the day from the Supreme Court.

Case: Chevron USA Inc. v. Plaquemines Parish

Author of Opinion: Justice Thomas

Joined by: Unanimous judgement, Justice Jackson concurred in the judgement. *Justice Alito recused.

Dissented: none.

Holding: Chevron has plausibly alleged a close relationship between its challenged crude-oil production and the performance of its federal avgas refining duties—not a tenuous, remote, or peripheral one—and has therefore satisfied the “relating to” requirement of the federal officer removal statute.

FCC v. AT&T - Verizon Communications v. FCC.

The court will hear an issue on the FCC’s enforcement of monetary forfeitures, and whether they are consistent with the Seventh Amendment and Article III.

Good Wednesday Morning Everyone!

It’s another opinion day at the Supreme Court. The justices will hand down one or more opinions in argued cases so far. Since we are not fortune tellers, we don’t know which cases will be released or when, so we are all in the curiosity boat together.

Case: Enbridge Energy, LP v. Nessel

Author of Opinion: Justice Sotomayor

Joined by: Unanimous Court

Dissented: none.

Holding: Because §1446(b)(1)’s text, structure, and context are inconsistent with equitable tolling, Enbridge’s removal was untimely.

Case: Hencely v. Fluor Corp.

Author of Opinion: Justice Thomas

Joined by: Justices Sotomayor, Kagan, Gorsuch, Barrett and Jackson.

Dissented: Justice Alito, joined by Chief Justice Roberts and Justice Kavanaugh.

Holding: The Fourth Circuit erred in finding Hencely’s state-law tort claims preempted where the Federal Government neither ordered nor authorized Fluor’s challenged conduct.

NOTE - According to reports, no Supreme Court Justice was in attendance of the White House Correspondents Dinner, where there has been an apparent shooting. There have been times in the past where justices attended upon invitation, tonight was not one of them.

Here is the first case of the day from the Supreme Court.

Case: First Choice Women’s Resource Centers, Inc. v. Davenport

Author of Opinion: Justice Gorsuch

Joined by: Unanimous Court.

Dissented: None.

Holding: First Choice has established a present injury to its First Amend-
ment associational rights sufficient to confer Article III standing.

Case: Louisiana v. Callais

Author of Opinion: Justice Alito

Joined by: Chief Justice Roberts, Justice Thomas, Gorsuch, Kavanaugh, and Barrett

Dissented: Justice Kagan, joined by Justice Sotomayor and Jackson.

Holding: Because the Voting Rights Act did not require Louisiana to create an additional majority-minority district, no compelling interest justified the State’s use of race in creating SB8, and that map is an unconstitutional racial gerrymander.

NEW - You may have seen headlines throughout today saying something along the lines of "Supreme Court restores broad access to the abortion pill Mifepristone". It is important to understand what actually happened.

Justice Alito, who is in charge of overseeing cases appealed from the fifth circuit, issued an administrative stay on a ruling that blocked the said abortion pill from being administered by mail.

An administrative stay is a stay issued by a single justice, which puts a lower court ruling on hold, while the full court considers the matter. It is NOT a ruling on the merits, nor does it give any indication of how that particular justice will vote on the issue in the future.

BREAKING - Supreme Court immediately sends down its ruling on Louisiana V. Callais to the district court, despite the normal 32-day waiting period. Justice Alito concurred in the order, joined by Justices Thomas and Gorsuch. Justice Jackson dissents.
