- Case: Advocate Christ Medical Center v. Kennedy

- Authored by: Justice Barrett

- Joined by: Chief Justice Roberts, Justices Thomas, Alito, Kagan, Gorsuch and Kavanaugh.

- Holding: In calculating the Medicare fraction, an individual is “entitled to [SSI] benefits” for purposes of the Medicare fraction when she is eligible to receive an SSI cash payment during the month of her hospitalization

- Dissent: Justice Jackson filed a dissenting opinion, in which Justice Sotomayor joined.

The justices will start their day once again announcing one or more opinions in argued cases. Yesterday the Court only released one opinion, so we could only have one today but it’s a ‘wait and see’ game.

Following such, the justices will convene to hear two cases consolidated for one oral argument:

1). > OK Charter School Board v. Drummond
> St. Isidore of Seville Sch. v. Drummond

- Case: Feliciano v. Department Of Transportation

- Authored by: Justice Gorsuch

- Joined by: Chief Justice Roberts, Justices Sotomayor, Kavanaugh, and Barrett.

- Holding:A federal civilian employee called to active duty pursuant to “any other provision of law . . . during a national emergency” as described in §101(a)(13)(B) is entitled to differential pay if the reservist’s service temporally coincides with a declared national emergency without any showing that the service bears a substantive connection to a particular emergency.

- Dissent: Justice Thomas filed a dissenting opinion, in which Justices Alito, Kagan, and Jackson joined.

That is the only opinion of the day from the Supreme Court, there are no more opinion days this week.

Fun fact: Today is technically the last *regularly* scheduled oral argument day for the Supreme Court’s 24-25 term. Normally the justices would now begin their long haul weeks of drafting and finalizing the remaining opinions of the term (to which they still will be). The difference this term is the justices will be back for an oral argument next month, May 15. This day was scheduled as an argument day two weeks ago, it’s very rare for the Supreme Court to hold arguments in May. The case being heard is about the Trump administration’s initiative to dismantle birthright citizenship. While the case itself isn’t addressing the issue of birthright citizenship, the decision could allow the dismantling to take temporary effect while the lower courts process the case.

JUST IN: Thursday May 15 will be an opinion day at the Supreme Court.

BREAKING: Supreme Court allows Trump administration’s ban on transgender individuals in the military to take effect for now. Justice Sotomayor, Kagan and Jackson publicly dissented.

- The consolidation of cases relates to the Trump administration’s attempt to end birthright citizenship. Though the justices won’t be ruling on the merits itself, a decision in the case could temporarily dissolve birthright citizenship.

- Case: Barnes v. Felix

- Authored by: Justice Kagan

- Joined by: Unanimous Court

- Holding:A claim that a law enforcement officer used excessive force during a stop or arrest is analyzed under the Fourth Amendment, which requires that the force deployed be objectively reasonable from “the perspective of a reasonable officer at the scene.”

- Dissent: N/A

JUST IN: Supreme Court will release one or more opinions in argued cases Thursday May 22, at 10amET.

BREAKING: Supreme Court, in what appears to be a 7-2 decision, has overturned a fifth circuit decision which dismissed an appeal from a group of immigrants from Venezuela that the Trump administration deemed members of a terrorist group and set to be deported under the Alien Enemies Act. The government, for now, it’s prohibited from removing the group until the fifth circuit court issues a new decision. Justice Thomas and Alito both dissented.

JUST IN: Supreme Court, in what appears to be an 8-1 decision, permits the Trump administration to end Biden-era temporary deportation protections for Venezuelan migrants during ongoing court challenges. Justice Jackson was the lone dissenter.

NEW: Supreme Court issues injunction against Maine State Legislatures’s refusal to allow Rep. Libby from voting following a censure vote against her for posting about a trans athlete. - Holding:: A defendant who induces a victim to enter into a transaction under materially false pretenses may be convicted of federal fraud even if the defendant did not seek to cause the victim economic loss

- Dissent: None.
