NEW: Trump administration has officially responded to the application for stay brought by foreign detainees against being deported under the Alien Enemies Act. The Supreme Court late last night issued what appears to be a full-court administrative stay (a temporary pause that doesn’t reflect how the court may rule on the application itself) on the Trump administration from carrying out the deportations. We will likely hear from the Supreme Court next week on what will happen next in the case.

JUST IN: Justice Alito, joined by Justice Thomas has issued his dissent towards the order from the Supreme Court last night against the Trump administration’s plans to deport detainees under the Alien Enemies Act.

NEW: Supreme Court adds a new case to its 2025–2026 term, which addresses Postal Service delivery issues, specifically whether it the claim ‘arises out of “the loss” or “miscarriage” of letters or postal matters.’

Good Tuesday Morning Everyone!

The justices will start their day this morning at 10 AM ET to hand down one or more opinions in argued cases so far this term.

Following the handing down of opinion(s), the justices will convene to hear two cases for oral arguments:

1). Mahmoud v. Taylor (24-297)

2). CIR v. Zuch (24-416)

The first case is one of many controversial cases being heard this term. It dives into the “parent’s rights” movement, and their ability, based on religious beliefs, to control what their student can learn in school, specifically as it relates to gender and sexuality.

- Case: Monsalvo Velazquez v. Bondi

- Authored by: Justice Gorsuch

- Joined by:Chief Justice Roberts, Justices Sotomayor, Kagan and Jackson.

- Holding: "This Court has jurisdiction to review Monsalvo’s petition. Under §1252, courts may review “final order[s] of removal” and “all questions of law” arising from them. Monsalvo’s petition sought judicial review of a legal question about the meaning of a term in his final removal order—specifically, the meaning of “60 days” for voluntary departure. Although Monsalvo did not challenge his removability, nothing in §1252 requires an individual to press a challenge to one term in a final order of removal just to secure judicial review of another. This Court rejects the government’s argument that a petition must include a challenge to removability to secure judicial review. Such an interpretation would force litigants to assert meritless claims simply to obtain jurisdiction.

- Dissent: Justice Thomas filed a dissenting opinion, in which Justice Alito joined, and in which Kavanaugh and Barrett joined as to Parts I and II. Justice Alito and Barrett filed dissenting opinions, in which Justice Kavanaugh joined.

NEW: Supreme Court orders additional briefs in the Kennedy v Braidwood Management Inc, following arguments held on Monday in the case. While rare, there are other times that the Supreme Court has ordered post-argument briefs. A general explanation for the matter is new developments in the case, from the time of the argument, that prompts additional information to be provided from both parties to the justices.

- Case: Feliciano v. Department Of Transportation

- Authored by: Justice Gorsuch

- Joined by: Chief Justice Roberts, Justices Sotomayor, Kavanaugh, and Barrett.

- Holding:A federal civilian employee called to active duty pursuant to “any other provision of law . . . during a national emergency” as described in §101(a)(13)(B) is entitled to differential pay if the reservist’s service temporally coincides with a declared national emergency without any showing that the service bears a substantive connection to a particular emergency.

Fun fact: Today is technically the last *regularly* scheduled oral argument day for the Supreme Court’s 24-25 term. Normally the justices would now begin their long haul weeks of drafting and finalizing the remaining opinions of the term (to which they still will be). The difference this term is the justices will be back for an oral argument next month, May 15. This day was scheduled as an argument day two weeks ago, it’s very rare for the Supreme Court to hold arguments in May. The case being heard is about the Trump administration’s initiative to dismantle birthright citizenship. While the case itself isn’t addressing the issue of birthright citizenship, the decision could allow the dismantling to take temporary effect while the lower courts process the case.
