US District Judge Leonic Brinkema in Alexandria, Virginia ordered the DOJ to temporarily halt setting up the Compensation Funds until further adjudication upon a following Court hearing on Friday, June 10th, 2026.
She ordered a response from the DOJ to the legal challenge by June 5th 2026.
The compensation work by the DOJ is at least delayed until after June 10th.

Framework for the Anti-Weaponization Fund Commission and Affected Defendants
EXECUTIVE SUMMARY
The Department of Justice’s new Anti-Weaponization Fund, created as part of a settlement resolving President Trump’s IRS lawsuit, is a roughly $1.776–$1.8 billion pool intended to compensate people who can show they were victims of politicized federal enforcement. It will be administered by a five-member commission appointed by the Attorney General with one member selected in consultation with Congress. Acting Attorney General Todd Blanche has stated that anyone who credibly alleges weaponization may apply, and that the fund is not limited by political party or to January 6 cases. At the same time, a federal judge has temporarily enjoined implementation of the fund, pending a June hearing, underscoring the need for rigorous, principled standards.
This paper offers a framework grounded in existing wrongful-conviction law, civil-rights remedies, and empirical data on jury awards. Serious wrongful prosecutions and wrongful imprisonment are already compensated in the low- to high-seven-figure range in courts and statutory schemes. A conservative baseline of $50,000 per year of wrongful imprisonment—widely used in federal and state statutes—should be treated only as a floor.
A recent empirical study of hundreds of wrongful-conviction awards finds an average total award of about $6.1 million per exoneree, illustrating the true scale of harm.
We propose that the Anti-Weaponization Commission:
- Use a per-year liberty-loss benchmark of at least $50,000 per year of wrongful incarceration.
- Add separate economic, non-economic, and family-damage components based on the claimant’s age, income, and dependents.
- Apply an aggravated “weaponization uplift” where there is clear evidence of political or ideological misuse of prosecutorial power.
- Recognize collective reform demands aimed at deterrence and structural change, including a separate monetary deterrence fine and a comprehensive package of DOJ and court reforms.
The result is that typical cases involving a few years of clearly weaponized incarceration will usually justify total awards in the low- to mid-seven-figure range, with higher awards for longer terms or higher earners. These numbers are not windfalls; they reflect what courts and legislatures already accept as the real cost of wrongful prosecutions.
