“Alhamdulillah today commenced a 5-Day intensive seminar by Sh. Sami Sugayr حفظه الله in the city of Unayzah, KSA at the masjid Sh. Ibn Uthaymeen رحمه الله used to teach in.

Sh. Sami is explaining Furu' al-Fiqh by ibn Abdil-Hadi after Fajr, a Riyadh-Saliheen reminder after Asr Salah, a treaty by Ibn Taymiyyah "Raf' al-Malaam" after Asr, and "Usul Sittah" after Maghrib.

During his Fajr class in fiqh, he mentioned a benefit related to bargaining when buying and selling.

The one who doesn't have the skill of bargaining is referred to as "مسترسل Mustarsil".

Normally when sellers are often asked for discounts, they usually raise the initial price of the item so as to sell the item for its actual price and not lose profit.

For example, if an item costs 80 riyals, it would be announced for 100, then when asked for the discount it would sell for the original 80.

There is nothing wrong with the seller's action.

However, if the customer does not bargain the 100, then it is not permissible for the seller to sell it for that price.

They must sell it for its actual price of 80.
That is because the 20 extra was only added for the purpose of countering the bargainer's request. If there is no request, then the item must be sold for its original price of 80... ” [End quote]
Commentary:

The post makes it seem like it's not allowed to bargain whatsoever - “the item must be sold at its original price of 80.” It does not take into account the permissibility of الغبن اليسير (a small price increase).

The jurists have categorised الغبن (overcharging) into two types:
1. الغبن الفاحش
A substantial price increase. This is not permitted.
2. الغبن اليسير
A small price increase. This is permitted.

If someone is overcharged substantially for an item, they have the option (خيار) of revoking the transaction and getting their money back; this is what the post alludes to. But if the price increase is minimal, then it is allowed within the Shari’ah.

{وَأَحَلَّ ٱللَّهُ ٱلۡبَیۡعَ وَحَرَّمَ ٱلرِّبَوٰا۟ۚ}
“Allah has permitted trade and has forbidden usury.”
[Surah Al-Baqarah: 275]

Sheikh 'Uthaymeen rahimahullah said

”إذا اشترى سلعة بـ (2500) ريال، وهي لا تساوي إلا (1500) ريال، فإن كان البائع يعلم أن السعر (1500) ريال، ولكنه وجد هذا الرجل الغريب الذي لا يعرف الأسعار وباعها عليه بـ (2500)، فإنه آثم ولا يحل له ذلك، وإذا علم المشتري بهذا فله الخيار، وهذا يسمى خيار الغبن؛ لأن (1000) من (2500) كثير. وأما لو كان الغبن يسيراً كـ (10%)، فهذا لا يضر، ولا يزال الناس يتغابنون بمثله. أما إذا كان البائع لا يعلم، مثل: أن تكون هذه السلعة بـ (2500)، ونزل السعر والبائع لا يدري بنزوله، فالبائع غير آثم، لكن حق المشتري باقٍ، وله الخيار؛ لأنه مغبون.“

“If someone buys an item for 2500 riyals while its worth is only 1500 riyals, and the seller knows that the price is 1500 riyals, but he takes advantage of this strange man who does not know the prices and sells it to him for 2500, then he is sinful and it is not permissible for him to do that, and if the buyer finds out, he has the option (to annul the transaction), and this option is known as "خيار الغبن"; because 1000 out of 2500 is a substantial price increase. But if the price increase was something small, like 10% for example, then there is no harm, and people continue to trade in this way. But if the seller is not aware, such that he sells the item for 2500 although its market price has dropped, but the seller (continues to sell at 2500) unaware that the price has dropped, then the seller is not sinful, but the right of the buyer remains, and he has the option (i.e. خيار الغبن) because he has been overcharged.”

Alhamdulillah, today commenced a 4-day intensive conference in the city of Dammām with our Sh. Khalid al-Mushaygih explaining Akhsar al-Mukhtasarāt, and later with our Professor Sh. Ghazi Utaybi حفظهما الله explaining Imam Sa'di's رحمه الله Usul Fiqh matn Risalah Latifah.

💎 Benefit: Sh. Khalid غفر الله له said that when it comes to the "Sunan al-Fitrah" then it can fall under the following rulings:

1. When it's recommended to cut:
A. It is said on a weekly basis.
B. There is another opinion selected by the Shaykh to be the most correct and that is whenever it gets "long" (and this can differ from person to person).

2. When it's disliked to keep. This is when it grows past 40 days. There's a narration that states:

"He set us a time limit of no more than forty days for trimming the moustache, clipping the nails, plucking of armpit hairs and shaving the pubic hair." (Muslim)

(Why is it disliked and not prohibited? This is due to the principle that if there is a prohibition related to etiquette -not Ahkam- then origin is that the prohibition takes the ruling of disliked, unless there is something else to show otherwise i.e., a punishment is mentioned along with it.)

3. It becomes impermissible to keep and an obligation to cut. This is whenever it grows to an extent that it resembles animals and/or the polytheists (as we are prohibited against resembling and imitating them).

Is the mark on some people's forehead a sign of Iman or just sensitive skin?

In tonight's explanation of Sunan ibn Majah, our Sh. Muhammad Bazmool حفظه الله explained the description of the prayer. When he reached the rulings related to Sajdah, he mentioned the verse:

سِيمَاهُمْ فِي وُجُوهِهِم مِّنْ أَثَرِ السُّجُودِ ۚ
"The mark of them (i.e. of their Faith) is in their faces (foreheads) from the traces of prostration (during prayers." (48/29)

He clarified that the intended meaning of the "Sajdah Mark" is not an actual physical marking that you see on some people's forehead. Instead, it is a light, brightness, calmness, and peace in their faces. This is corroborated by the Tafsir of the Salaf.

If the intent was an actual marking, then it would have said in Arabic على وجوههم meaning "on their faces", but Allah said "in their faces في وجوههم".

Additionally, we know that the Prophet صلى الله عليه وسلم was described in detail, yet, we have no narration that describes him with this mark on his forehead.

Pure souls mixing with the filthy ones is as common as the mixture of oil & water.

Alhamdulillah a couple weeks ago I was able to buy the new copy of Imam Nawawi's explanation of Sahih Muslim "al-Minhāj" (pictured on the left). I'm currently in the process of transferring my notes from my old copy to the new one. I reached the hadith that states:

"Souls are troops collected together; those who are familiarized with each other (in the heaven) have affinity with one another (in the world)."

And I came across a benefit I wrote down on the margins as mentioned by Shaykh Waseeullah Abbas حفظه الله at our University.

He said that if souls have the same ideals, passion, & goals, they will naturally incline to each other. This is affirmed in the Quran:

وَالْمُؤْمِنُونَ وَالْمُؤْمِنَاتُ بَعْضُهُمْ أَوْلِيَاءُ بَعْضٍ ۚ يَأْمُرُونَ بِالْمَعْرُوفِ..إلخ

"The believers, both men and women, are guardians of one another. They encourage good and forbid evil, establish prayer and pay alms-tax, and obey Allah and His Messenger. It is they who will be shown Allah’s mercy. Surely Allah is Almighty, All-Wise." (9:71)

Notice Allah begins by saying that the believers are Awliyā to one another, then He mentions the common actions they engage in. The Arabs also have a saying: إن الطيور على أشكالها تقع essentially meaning, "Birds of a feather flock together". This is something well known & established.

Also the verse:
الْخَبِيثَاتُ لِلْخَبِيثِينَ وَالْخَبِيثُونَ لِلْخَبِيثَاتِ ۖ وَالطَّيِّبَاتُ لِلطَّيِّبِينَ وَالطَّيِّبُونَ لِلطَّيِّبَاتِ ۚ أُولَٰئِكَ مُبَرَّءُونَ مِمَّا يَقُولُونَ ۖ لَهُم مَّغْفِرَةٌ وَرِزْقٌ كَرِيمٌ

After explaining a few other points related to the hadith, the Shaykh حفظه الله mentioned a remarkable story & real life example of this hadith. He said that there was once a non-Muslim french woman dating a Muslim "non-practicing" man who was drowning in sins. They both loved each other deeply, madly in love you can say.

One day, the man casually mentioned something about Islam & it peaked her interest. She did her own independent research & eventually reverted to the Deen. When she told him the good news, he was elated! But soon afterwards she informed him that the relationship had to end because his mindset & actions did not reflect the Islamic teachings that she wanted to now practice in her own life.

Before her Islam, both of their souls were allured to each other because they were in a similar state (a bad one to say the least). After she was given the light of Islam, her soul was no longer fascinated with his (which was covered in the darkness of filth and no desire of change).

Instead, she craved something better & yearned to be with those who truly worship their Lord in the way it was revealed. So she left him. Subhanallah...

This applies to every affair. You'll never see one whose main concern is to seek & implement knowledge mixing with the time-wasters, failures, & people of low ambition - even if they are cloaked in the garbs of Sunnah. Why? Because the Prophet said:

"Souls are troops collected together; those who are familiarized with each other (in the heaven) have affinity with one another (in the world)." (Agreed upon)

Abū Hurayrah (may Allah be pleased with him) reported that the Messenger of Allah ﷺ said: “In Paradise, there are one-hundred levels, between every two levels is a (distance of) one-hundred years.”

▪️Doing transactions with the disbelievers and the affair of boycotting their products▪️

Answered by Shaykh Abul-Yamān Adnān Ibn Hussain Al-Masqarī - May Allāh preserve him

📩 Question:

Does buying products from the kuffār enter into the affair of Al-Walā wa Al-Barā (allegiance and disallegiance)?

📝 Answer:

No. Partaking in worldy related dealings and transactions with the disbelievers is permissible, and those who say that we (should) boycott the products of the kuffār, America, and the products of such and such country; they're (in reality) liars. For they boycott the goods only for worldly related benefits whilst they don't boycott the notions.

They adopt their many notions from partisanship, democracy, revolting, strikes, and likewise imitating them in their clothing and other than that. They don't boycott their notions or methodologies. Then some companies may come and stir them up, resulting in them saying "we will boycott such and such company and country". This is not from the religion.

{ وَتِلۡكَ ٱلۡأَمۡثَـٰلُ نَضۡرِبُهَا لِلنَّاسِۖ وَمَا یَعۡقِلُهَاۤ إِلَّا ٱلۡعَـٰلِمُونَ }

"(And these similitudes We put forward for mankind), but none will understand them except those who have knowledge."

[Sūrah Al-`Ankabūt: 43]

So ask the people of knowledge.
