A great blow: Switzerland withdraws all Covid vaccination recommendations

Switzerland halts Covid vaccinations: All vaccination recommendations have been withdrawn, and doctors can now only administer the controversial vaccines in individual cases under certain conditions - but then bear the risk of liability in the event of vaccine damage. When will countries like Germany and Austria follow this example?

The Federal Office of Public Health (FOPH) and the Federal Commission for Immunization Issues (EKIF) state, as of 3.4.23, in their vaccination recommendation (found on this website):

In principle, the FOPH and EKIF do not formulate a recommendation for vaccination against Covid-19 in spring/summer 2023 due to the expected low virus circulation and high immunity in the population.
Only in individual cases vaccination is still possible - namely:

Vaccination is possible in particularly at-risk persons (BGP) ≥ 16 years of age if the attending physician considers it medically indicated in the respective epidemiological situation in the individual case, a temporarily increased protection against severe disease is to be expected and the last vaccination dose was at least 6 months ago.
However, no vaccination recommendation is explicitly made for patients at risk.

In the following, it is discussed that the efficacy of vaccination against current variants is reduced and short-lived - especially in at-risk individuals. Adaptation of mRNA vaccines has not kept pace with the evolution of variants, they say. The FOPH's recommendations could change if there is a new wave of outbreaks, but even then, vaccinations are no longer recommended for people younger than 65, according to the document.

No positive risk-benefit ratio

The statements on "adverse immunization events" (UIE) are also piquantly worded:

According to the current state of knowledge, the risk of a severe UIE with a recommended vaccination is much smaller than the risk of a complication caused by Covid-19, from which the vaccination protects. The benefit of vaccination administered according to the recommendation therefore outweighs possible risks.
With the valid non-recommendation, this means in essence that a positive risk-benefit ratio can no longer be established for any Covid vaccination.

Liability: Federal government out, physicians in the obligation

The new recommendations also have implications for liability. That's according to the FOPH's Covid vaccination strategy document (as of Nov. 29, 2022):

Compensation by the federal government to injured persons for vaccination damage is only considered for vaccinations if they were recommended or ordered by the authorities (see Art. 64 EpG).
However, even before this, the Confederation only paid compensation if the damage was not covered by the vaccine manufacturer, the vaccinating person or an insurance company. The person vaccinating - i.e. commonly the physician - can be held liable if he or she has violated the duty of care. In this context, it should be noted that the same rules regarding patient education apply to Covid vaccination as to all other vaccinations.

The fact is, however, that very few physicians are likely to have correctly informed their patients about all the risks and side effects and the limited efficacy of the Covid vaccines. Off-label use of vaccines (not uncommon with the Covid vaccines; for example, the bivalent mRNA vaccines are not licensed in Switzerland as initial vaccinations, not as boosters for people under 18 years of age, and not as a fifth vaccination) must also be discussed. For physicians, the justification of vaccinations will definitely become more difficult due to the changed recommendations, according to a document of the FOPH on emerging liability issues:
