CATCHWORDS: The applicant seeks review of a decision to reject his claim for compensation for pericarditis due to having a third dose of COVID-19 vaccine.
The respondent admits that the vaccine caused pericarditis but says that the injection did not arise from employment but from a lawful State Government vaccination directive.
In the alternative the respondent says that any liability for any injury is excluded by legislation.

HELD:
1. The injury arose as a result of both a vaccination mandate and the applicant’s employment - Section 7 of the Return to Work Act 2014 requires that employment be a significant contributing cause of a work injury, not its only or most significant cause – Section 7 is satisfied.
2. Section 32A of the Emergency Management Act 2004 (SA) (EM Act) does not prohibit the claim as the language of s 32A does not unmistakably and unambiguously lead to that conclusion.
Rejecting the claim does not achieve the objects of the EM Act.

1. Daniel Shepherd was required to have a third dose of COVID-19 vaccine if he wished to continue performing work as a child and youth support worker employed by the Department for Child Protection (DCP).
The following day he experienced chest pain which grew steadily worse over the next few weeks.

2. The State now admits that the third dose of the vaccine resulted in Mr Shepherd caused the injury and incapacity for work.

41. In Dawking v Secretary (Department of Education), [11] the NSW Personal Injury Commission held that an email sent to the applicant which anticipated a direction that school-teachers would need to be vaccinated against COVID-19 caused the applicant to sustain a compensable psychiatric injury. The email was inaccurate in that it included teachers who did not teach on a face-to-face basis and were not subject to the direction. The email also failed to advise that a teacher could take leave if they did not wish to be vaccinated. On appeal, Wood DP distinguished Bjekic on the basis that the applicant in that case would have breached a public health order if he had not worn a face mask whilst there would have been no breach of a public health order on the facts in Dawking.

52. In Metropolitan Water Sewerage & Drainage Board v O.K. Elliott Ltd, 29 Starke J described the following principle: [30] Statutory powers must be exercised “with reasonable regard to the rights of other people,” and if an act is done in excess of the statutory power, or carelessly or negligently, then the person injured can put in force the ordinary legal remedy by action in the Courts of law.

53. In Coco v The Queen, [31] four High Court Justices said the following:
The courts should not impute to the legislature an intention to interfere with fundamental rights.
Such an intention must be clearly manifested by unmistakable and unambiguous language.

💥55. It follows that a statutory power which interferes with fundamental rights, freedoms or immunities must be carefully construed and a strict or jealous interpretation adopted. The language of the provision must be analysed in the context of the Act as a whole to see whether the provision authorises the exercise of power in question.💥

59. While liabilities under the RTW Act are statutory in origin, they can be classified as civil when they award compensation, or criminal when they create an offence.

60. I am not satisfied that Parliament intended s 32A to take precedence over a valid RTW Act claim.

63. Private sector employees not subject to the EM Act vaccination directions but nonetheless required by their employer to be vaccinated are not prevented from claiming compensation for vaccination related injuries.

67. It would be astonishing if Parliament intended that an employee of the State, injured adhering to an EM Act direction, was to be precluded from receiving workers compensation.

69. It would be ironic and unjust if Mr Shepherd was denied financial and medical support by complying with the State’s desire to preserve public health.

Day 4 of Trial

We entered the court at 10am to hear the CDPP response to Robert Size’s application to Stay the trial permanently.
The CDPP was not able to respond to Mr Size’s application because they had not received instruction from the Director of the CDPP
Again the matter was stood down while the advice was awaited
The defendants adjourned to the pub and returned to court at 2 pm.

Mr Justin Hannebery KC began immediately with a motion of discontinuance for Counts 1 & 2 (section 42 conspiracy charges) for the grandmother AG , Patrick O’Dea and Dr Russell Pridgeon.

The defendants were to be discharged.

And in a moment it was all over;
the trial was finished!

Dr Pridgeon dropped to his knees immediately to give thanks and the judge HH Lourey J began to scream “get out, get out, get out “ and continued until the defendants left the court.

Mr Size appeared to rise and Her Honour continued screaming at him as he left the court.

It wasn’t until the defendants left the courtroom that they were able to reflect upon the magnitude of Mr Size’s achievement.

This investigation and prosecution had been going for ?5 years before the arrests in October 2018. And for 5.5 years after the arrests with strict Bail conditions including gps ankle trackers.

This must have cost the tax payers tens of millions of dollars.

The prosecution was a farce and the 3 defendants had been able to whittle back the charges one by one using the superior legal arguments brought by Graeme Bell and others, with Pastor Paul ably assisting.

A special mention should be made about Serene Teffaha, an exceptionally courageous and pro-active solicitor who represented the grandmother AG pro bono.

She stood against the corrupt practices that she saw before her, and was maliciously disbarred by the Victoria Legal Services Board after a complaint by magistrate Anthony Gett.

She paid a terrible price for her courage and integrity.

It is uncertain how many barristers and solicitors have been involved with the Operation Noetic prosecution but none of them brought applications that caused their clients charges to be dropped. Yet Graeme and Paul and another unqualified person were able to get 5 out of the 7 charges faced by Dr Russell Pridgeon dropped by extraordinary efforts and the legal mind of Graeme Bell, a legal savant. The other defendants charges were dropped because of this.

They never gave up, they fought everything down to the wire, and never gave an inch.

Against this background, Mr Robert Size, a young man, acting for Dr Pridgeon pro bono, (an astonishing act of generosity giving weeks of his time before the trial and committing himself to a 4-5 week trial), showed us all how a defence should be planned and run. His level of organisation, his diligent reading of the largest brief in Australian legal history, his strategic planning of how he was to run this highly unusual case, and his superb knowledge and understanding of the law, gained by working with the finest legal minds in Australia was an object lesson in excellent legal practice.

He awoke on the morning of day 3 of the trial with an idea, and sat down to write the legal arguments out in a sitting.

In 3 paragraphs of concise, elegant and compelling legal arguments which he presented in a few minutes he destroyed the largest criminal case in Australian legal history.

Very few Barristers, no matter how gifted, manage a feat like this.

The defendants and their supporters recognised his merits as soon as they met him and held him in a kind of awe.

The magnitude of this victory over evil is breathtaking.

6 defendants had pleaded guilty to criminal charges seemingly because they were badly advised and simply gave up.

The protective mother languishes in jail as I write this, for the heinous crime of protecting her children from rape, sentenced to 3
years.

This trial was the final act in the paedophile agenda, where the act of protecting children was criminalised.

The fight to protect our children in Australia is all but lost. Well cared for, loved Children are now taken at will, from competent caring parents in significant numbers all across Australia.

It is heartbreaking to think that the 3 children remain in the custody of the men who they have clearly identified as their abusers for the past 6 years. The abuse they described was sadistic and painful.
