(2) For the purposes of this Part, a threat against an individual is taken not to be menaces unless:
(a) both:
(i) the threat would be likely to cause the individual to act unwillingly; and
(ii) the maker of the threat is aware of the vulnerability of the individual to the threat; or
(b) the threat would be likely to cause a person of normal stability and courage to act unwillingly.

4 Relationship to common law and other matters
(1) Unless this Act otherwise provides expressly or by implication, this Act does not limit:
(a) the functions, obligations and liabilities that a police officer has as a constable at common law, or
(b) the functions that a police officer may lawfully exercise, whether under an Act or any other law as an individual (otherwise than as a police officer) including, for example, powers for protecting property.
(2) Without limiting subsection (1) and subject to section 9, nothing in this Act affects the powers conferred by the common law on police officers to deal with breaches of the peace.
Part 14 Powers to give directions
200 Limitation on exercise of police powers (cf Summary Offences Act 1988, s 28G)
This Part does not authorise a police officer to give directions in relation to:
(a) an industrial dispute, or
(b) an apparently genuine demonstration or protest, or
(c) a procession, or
(d) an organised assembly.

6 Mission and functions of NSW Police Force
(1) The mission of the NSW Police Force is to work with the community to reduce violence, crime and fear.
(2) The NSW Police Force has the following functionsโ
(a) to provide police services for New South Wales,
(b) to exercise any other function conferred on it by or under this or any other Act,
(c) to do anything necessary for, or incidental to, the exercise of its functions.
(3) In this sectionโ police services includesโ
(a) services by way of prevention and detection of crime, and
(b) the protection of persons from injury or death, and property from damage, whether arising from criminal acts or in any other way,
7 Statement of values of members of NSW Police Force
Each member of the NSW Police Force is to act in a manner whichโ
(a) places integrity above all,
(b) upholds the rule of law,
(c) preserves the rights and freedoms of individuals,
(d) seeks to improve the quality of life by community involvement in policing,
(e) strives for citizen and police personal satisfaction,
(f) capitalises on the wealth of human resources,
(g) makes efficient and economical use of public resources, and
(h) ensures that authority is exercised responsibly.
14 Additional functions of police officers
(1) In addition to any other functions, a police officer has the functions conferred or imposed on a constable by or under any law (including the common law) of the State.
(2) Nothing in this section confers on a police officer a power to exercise a function in a way that is inconsistent with any provisions applicable to police officers under the Law Enforcement (Powers and Responsibilities) Act 2002.

(c) the person has committed a serious indictable offence for which the person has not been tried.
(2) A person who arrests another person under this section must, as soon as is reasonably practicable, take the person, and any property found on the person, before an authorised officer to be dealt with according to law.
