A new divorce law in China, effective February 1, 2025, which significantly alters property division and ends mandated alimony:
• The law introduces a “Who Pays, Owns” rule: property—including homes—goes to the spouse who actually paid for it, even if both names are on the title .
• Alimony or spousal support is now abolished—you must have a prior financial agreement (“prenup”) to qualify for post-divorce payments .
• Non-financial contributions (such as homemaking or childcare) carry no legal weight in property division under the revised law .
• The law also includes a mandatory 30-day “cooling-off” period for divorces, which critics argue could hinder victims of abusive marriages .
