9th Circuit Court Rules against former Vaccine Mandate for LA School district

"Addressing the merits, the panel held that the district court misapplied the Supreme Court’s decision in Jacobson v. Massachusetts, 197 U.S. 11 (1905), in concluding that the Policy survived rational basis review. Jacobson held that mandatory vaccinations were rationally related to preventing the spread of smallpox. Here, however, plaintiffs allege that the vaccine does not effectively prevent spread but only mitigates symptoms for the recipient and therefore is akin to a medical treatment, not a “traditional” vaccine. Taking plaintiffs’ allegations as true at this stage of litigation, plaintiffs plausibly alleged that the COVID-19 vaccine does not effectively “prevent the spread” of COVID-19. Thus, Jacobson does not apply.

Pursuant to more recent Supreme Court authority, compulsory treatment for the health benefit of the person treated—as opposed to compulsory treatment for the health benefit of others—implicates the fundamental right to refuse medical treatment. Plaintiffs’ allegations here are sufficient to invoke that fundamental right."

“A federal jury has awarded $687,000 to a research scientist who was fired from BlueCross BlueShield in Tennessee for refusing to comply the company’s COVID-19 vaccine mandate.

Tanja Benton, who had worked 16 years at the firm when she was fired, was awarded $177,240 in back pay, $10,000 in compensation, and $500,000 in punitive damages, according to a document made public by the federal court in eastern Tennessee on June 30.

BlueCross BlueShield ‘cannot prove that allowing Plaintiff to continue her employment as a Bio Statistical Research Scientist without being vaccinated for COVID-19 constitutes an undue hardship,’ the suit stated. The company ‘also cannot show that it made any good-faith efforts to accommodate plaintiff’s sincerely held religious beliefs.’”

And what the chart shows is that none of the vaccines on the childhood schedule were tested against an inert saline placebo and none of the trials were long enough to accurately measure harms. Therefore, a true risk versus benefit assessment cannot be made.

In a recent CDC publication, Morbidity and Mortality Weekly Report (MMWR), the flu shot for the 2024-2025 flu season was shown to have only 35% efficacy in South America.

The adjusted Vaccine Efficacy was 34.5% against hospitalization, 36.5% against the predominant A(H3N2) influenza substrain, and 37.1% against the A(H1N1)pdm09 substrain.

"The vaccine effectiveness estimated is within the confidence interval of prior H3N2 (34%–53%) and H1N1 (18%–56%) for this Southern Hemisphere network," Zeno said. "It is lower than what was observed in the United States last season, but that was on the high-end of the historic range."

A $7.8 million payout from BART was awarded to six employees after accomodations were denied for their religious exemption to COVID-19 vaccinations.

On October 14, 2021, BART issued a “COVID-19 Vaccination Policy” imposed by the transit agency’s board of directors in fall 2021, requiring all employees to be fully vaccinated as a condition of employment.

“Of the 179 religious objector employees, not one received an accommodation. Exclusion of religious people from the enjoyment of a right stands in violation of the First Amendment’s religion clauses and federal and state anti-discrimination in employment laws. 109 employees’ requests for religious exemption were denied,” attorneys wrote.

A jury in Detroit awarded former Blue Cross Blue Shield IT specialist of more than 30 years $10 M in punitive damages, $1.7 M in lost wages, and $1 M in noneconomic damages.

The plaintiff was denied a religious exemption from the 2021 vaccine mandate.

She worked remotely before the pandemic and worked 100% remotely during the pandemic so she posed no risk to others at BCBS. Now that it is known the genetic vaccines were not safe nor effective more lawsuits are expected to swing in favor of the wrongfully terminated.

Study finds children with comorbidities report more side effects after vaccination with BNT162b2 than healthy children.

Researchers in Germany conducted the PaedVacCOVID study tracking the safety of the Pfizer-BioNTech BNT162b2 vaccine against SARS-CoV-2 in children with and without comorbidities aged 5 to 11 years.

This study introduces a significant, even “striking” safety signal when comparing safety incidents linked to the Pfizer mRNA Vaccine impacting children with immunocompromised conditions versus healthy children. The Odds Ratios are quite high, and this reality may have put already vulnerable children in danger.

These side effects include gastrointestinal, otolaryngologic, pulmonary, neurological, psychological and dermatological symptoms.

The data emphasizes the importance of evaluating short and long term safety of the new mRNA COVID-19 vaccines not only in healthy children but also in children with comorbidities.

'Safety signal’ in Moderna’s RSV vaccine for Infants

Two experimental RSV vaccines for babies may not only have failed to protect them, but actually made symptoms worse with more severe illness once infected with RSV or another respiratory virus.

Moderna first alerted FDA in mid-July that infants who had received one of two RSV vaccines unexpectedly had higher levels of severe respiratory disease than those given a placebo injection.

A trial in Panama enrolled children ages 5 months to 7 months old to receive an mRNA vaccine for RSV or RSV+hMPV combo. Five of 40 who received either RSV vaccine and later became infected with RSV developed severe or very severe cases of lower respiratory tract infections, compared with one of 20 children in the placebo group. Among the 27 infants who got the combo vaccine, three later became seriously ill from hMPV infections versus none in the placebo group.

An RSV vaccine trial in the 1960s infamously sent 80% of vaccinated children to the hospital; two died. Vaccination primed their immune system so that during an infection helpful T cell responses were blunted and high levels of infection enhancing antibodies were produced, forming dangerous airway-clogging complexes.

RSV is not amenable to vaccination!

H5N1 bird flu from cows results in limited infection and disease in monkeys that were exposed to high levels of virus through the gastric or nasal routes. Likewise, no human to human transmission has been observed.

Macaques were exposed via three inoculation routes to the strain of the virus circulating in US dairy cattle. Researchers exposed macaques to the virus intranasally to mimic an upper respiratory tract infection, intratracheally to mimic a lower respiratory tract infection, and orogastrically to mimic consumption of dairy products.

Intranasal exposure can cause systemic infection, but animals displayed attenuated disease with mild to moderate pneumonia, virus clearance and survival. Orogastric inoculation did not result in systemic infection and largely led to virus replication with minimal pathology in those tissues/organs lining the inoculation route but only subclinical disease.

CDC Launches Conflicts of Interest Page for Members of Vaccine Advisory Committee

The CDC's new list includes names of members, the dates they served and what the agency describes as conflicts of interests, such as previous work as a principal investigator for clinical trials funded by drug companies or whose institution received a grant from the industry.

Advisory Committee on Immunization Practices (ACIP) voting member Yvonne Maldonado, professor of pediatrics and epidemiology and population health at Stanford University, has two items listed under her name but one is explicitly stated to represent “no conflict of interest.” The item instead is a note relaying she had previously served on the data and safety monitoring board for Pfizer meningococcal vaccine trials and served in similar roles for other vaccine trials, including as a site Principal Investigator for Pfizer pediatric COVID-19 and maternal RSV vaccines later approved by the committee.

Offit served as a member of ACIP from 1998 to 2003. Under his name are 8 items listed, most noting that he is the co-holder of several vaccine patents.
Offit, a former member of the ACIP who has criticized Kennedy in the past, said the website represents Kennedy's "basic belief that Big Pharma has had undue influence on vaccine policy decisions."

"There is not a single shred of evidence showing that is true," Offit added.

Offit held a $1.5 million dollar research chair at Children's Hospital, funded by Merck. He holds the patent on an anti-diarrhea vaccine he developed with Merck, Rotateq, for rotavirus.
As a vaccine industry insider He's gone so far as to say babies can tolerate "10,000 vaccines at once."

🧠 Brain maturation is altered in macaques that received the complete US childhood vaccine schedule ‼️

This longitudinal, case-control pilot study examined amygdala growth in rhesus macaque infants receiving the complete US childhood vaccine schedule (1994-1999). Longitudinal structural and functional neuroimaging was undertaken to examine central effects of the vaccine regimen on the developing brain.

Volumetric analyses identified significantly greater total brain volume in exposed compared with unexposed animals at both measured time points. A rapid increase in total brain volume between 6 and 14 months is generally considered to be a consistent finding for many children with an Autism Spectrum Disorder (ASD).

Findings in this study suggest that the currently approved vaccine schedule may be associated with significant disturbances in childhood brain growth and development. Even more immunizations have been added to the childhood vaccination schedule since this study was completed. Additional research into the impact of the current vaccine schedule on neurodevelopment is imperative.

NEW STUDY confirms at least 45% of “COVID deaths” were misclassified.

A team of top Greek researchers analyzed the death data from seven hospitals in Athens, Greece.

Among 530 in-hospital deaths, registered as COVID-19 deaths, in seven hospitals in Athens during the Omicron wave, 240 (45.28%) were reassessed as not directly attributable to COVID-19.

Those patients died from other causes, but their deaths were recorded as being caused by COVID-19. Patients infected during hospitalization were significantly more likely to be misclassified as COVID-19 deaths (OR: 2.3, p = 0.001).

Similar death coding practices were employed across most Western nations therefore, it is likely that death counts were artificially inflated to a comparable degree elsewhere.

Accuracy in defining the cause of death during the COVID-19 pandemic is of paramount importance for surveillance and intervention purposes.
