The curious case of GNCTD- A thread.

GNCTD (Amendment) Ordinance 2023- Creates a permanent authority- National Capital Civil Service Authority- for transfer, vigilance and other matters for services, comprising of Delhi CM, Chief Secy and Principal Home Secy of Delhi Govt.

All matters shall be decided by majority of votes of the members present and voting to make recommendations to the Delhi LG. In case of difference of opinion, decision of LG to be final.

GNCTD vs UoI (2023)- GNCTD a Sui generics federal model- has legislative and executive power over administrative services in NCT, excluding matters relating to public order, police and land. The Lieutenant Governor shall be bound by the decision of Delhi government on the same.

2022- 3- judge Bench headed by then CJI N V Ramana, acting on a plea by the Centre, on question of control over administrative services refers to Constitutional Bench (above) as it requires further examination.

GNCTD Amendment Act 2021- The “government” in the National Capital Territory of Delhi means Lieutenant-Governor of Delhi and before taking executive action opinion of the LG to be obtained + discretionary powers to LG. (1/2)

It bars the Assembly or its committees from making rules to take up matters concerning day-to-day administration, or to conduct inquiries in relation to administrative decisions. (2/2)

GNCTD vs UoI (2019)- Split verdict- agreed Entry 41 of List II of 7th Schedule of the Constitution isn’t available to Delhi Legislative Assembly as SPSC doesn’t exist in NCT but differed on power to transfer & appoint certain officers- goes to 3 judge bench.

GNCTD vs UoI (2018)- The status of NCT of Delhi is sui generis, but can’t be accorded status of a state under present Constitutional scheme , and the status of the Lieutenant Governor of Delhi is not that of a Governor of a State, rather he remains an Administrator. (1/5)

However by the A. 239AA inserted via 69th Amendment, Parliament envisaged a representative form of Government for the NCTD. Provides for an elected Legislative Assembly with powers over State and Concurrent List barring exceptions like public order, police, land. (2/5)

239AA (3) (a)- Parliament has the power to make laws for NCTD with respect to any matters enumerated in the State List and the Concurrent List as well. (3/5)

Executive power of GNCTD co extensive with the legislative power of the Delhi Legislative Assembly but if the Parliament makes law wrt subject in State/ Concurrent List, the executive action of the State must conform to the same. (4/5)

Lieutenant Governor of NCT of Delhi is bound by the aid and advice of the Council of Ministers except when he decides to refer the matter to the President for final decision keeping in mind constitutional morality and collaborative federalism. (5/5)
