Pakistan’s 27th Constitutional Amendment — Why it Matters (for India–Neighbourhood & Constitution Comparison)

- Supercharged Military Authority
-
The Army chief now also becomes Chief of Defence Forces, putting the Army, Navy, and Air Force under one office.
- A new post—Commander of National Strategic Command—is created to oversee nuclear assets, appointed largely on the Army chief’s recommendation.
- The most controversial twist: “Five-star officers” now get lifelong legal immunity. No civilian court can prosecute them.

- Civilian Leadership Further Eclipsed
-
These changes place the military hierarchy above civilian offices, which only enjoy limited immunity while in office.
- Parliamentary governments remain fragile—one simple majority can topple a PM—but the military leadership is now shielded beyond democratic oversight.

- Supreme Court Diluted via a New Super-Court
-
A new Federal Constitutional Court (FCC) is created.
- It takes over key functions of the Supreme Court—fundamental rights cases, constitutional disputes (centre–province, province–province), and presidential references.
- The Supreme Court becomes merely a final appellate court for civil and criminal matters.
- FCC judges will be appointed by the government, and its decisions bind all other courts.
- High Court judges can now be transferred without their consent—non-compliance means forced retirement.
