From Kitab Tawheed

Chapter no: 43 what is said about the one who is not satisfied with an oath taken by Allaah’s name

Ibn umar (may Allaah be pleased with him) narrated that Allaah’s Messenger (may the peace and blessing of Allaah be upon him) said:
“Do not swear by your forefathers. Whoever swears by Allaah, let him speak the truth. And the one for whom the oath is taken in the name of Allaah, should be satisfied with it, and whoever is not satisfied, is not from the slaves of llaah.”

[this hadith was reported by Ibn majah with good isnad)]

Important issues of the chapter

1) to make an oath by forefathers is not allowed.

2) the person for whom an oath by Allaah’s name is made, must be acceptant of it.

3) the punishment for the person who is not satisfied by an oath made by Allaah’s name.

باب ما جاء فيمن لم يقنع بالحلف بالله

عن ابن عمر -رضي الله عنهما- أن رسول الله - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ- قال: "لا تحلفوا بآبائكم من حلف بالله فليصدق، ومن حُلِف له بالله فليرض، ومن لم يرض فليس من الله"

باب: 43
اللہ تعالی کی قسم پر اکتفانہ کرنے والے کا حکم

ابن عمر رضی اللہ عنہما سے روایت ہے، رسول اللہ ﷺنے فرمایا:
لَا تَحْلِفُوا بِآبَائِكُمْ، مَنْ حَلَفَ بِاللَّهِ فَلْيَصْدُقْ، وَمَنْ حُلِفَ لَهُ بِاللَّهِ فَلْيَرْضَ، وَمَنْ لَمْ يَرْضَ فَلَيْسَ مِنَ اللَّه

[سنن ابن ماجہ، الکفارات، باب من حلف لہ باللہ فلیرض، ح:2101]

”تم اپنے آباؤ اجداد کی قسمیں نہ اٹھایاکرو۔ جو شخص اللہ تعالی کی قسم اٹھائے اسے چاہیے کہ وہ سچی قسم اٹھائے۔ اور جس کے لیے اللہ تعالی کی قسم اٹھائی جائے اسے چاہئے کہ وہ اسے تسلیم کرے، اور جو اسے تسلیم نہ کرے، اس کا اللہ تعالی سے کوئی تعلق نہیں۔“①

📕 مسائل:

1. اس حدیث سے معلوم ہوا کہ آباؤاجداد کی قسم اٹھانا منع ہے۔

2. اور اللہ تعالی کی قسم اٹھوانے والے کو چاہیے کہ وہ اس قسم کو تسلیم کرکے معاملہ کو اللہ تعالی کے سپرد کردے۔

3. جو شخص اللہ تعالی کی قسم اٹھوانے کے بعد بھی راضی نہ وہ اس کا اللہ تعالی سے کوئی تعلق نہیں۔
