The Supreme Federal Court and its electoral police, the TSE, have completely destroyed the honesty of the presidential election to be decided on October 30; they are now openly favoring one of the candidates, former president Lula. To do this they have violated Brazilian law, they have expropriated the electoral propaganda time to give their chosen one the time that is legally due to the opponent, and, worst of all, they have given themselves censor powers that are absolutely forbidden by the Federal Constitution - to them or to any authority in Brazil.

It is the most ruinous attack on democracy that the country has suffered since the proclamation of AI-5, in 1968. What is more: the censorship they imposed on the press, and on all 215 million Brazilian citizens, is unprecedented, not even in the worst moments of the dictatorship, in terms of brutality, arrogance and stupidity.

The TSE, without the slightest shred of law that would allow it to do so, has stepped out of its legal role as enforcer of the rules of the electoral timetable and has taken over everything - it now gives orders, 24 hours a day and on any subject, to the press, to journalists, and, in the end, to any Brazilian who wants to open his mouth to say anything against Lula, on the social networks or anywhere else.

It is forbidden to say, for example, that he was convicted by the courts for passive corruption and money laundering - or that he was never acquitted of anything. Worse still, the ministers have created prior censorship - a creeping violation of the principle that one can only punish a mistake after it has been committed. The result is that at the end of this campaign the following dementia has come about: journalists are forbidden to say what they have not yet said. That's right: "until October 31st", there are professionals and press organs that cannot write or speak.

The TSE is not punishing "false news", or any crime of slander, libel or defamation; by previously suppressing the right to speak, it is punishing offenses that have not been committed. Where in the Constitution is such a thing allowed?

The STF-TSE duo is not hurting the rights of journalists or the media; they are eliminating the population's right to be informed. Nor do they care to hide this. One minister declared in an open vote that any censorship is "inadmissible" - but that, on an "exceptional" basis, she was refusing to comply with the law. "Exceptional?" What can be exceptional, or dangerous, in a democratic election that, according to the STF and TSE themselves, has perfect voting and counting systems - the possibility that the opponent will win? That is what they are saying.
