Forge v ASIC sees the development of a second aspect of the Kable principle. In Kable v DPP, the High Court held invalid legislation passed by the Parliament of NSW that empowered the Supreme Court of NSW to make preventative detention orders. A majority of the High Court held that conferring this function on the Supreme Court was 'incompatible' with the exercise of federal judicial power by that Court. The legislation (which expressly applied to one individual, Mr Kable, and permitted detention even though no offence had been proved) gave the appearance that the court was an instrument of the executive government — a role far removed from ordinary judicial processes and standards.
