Human rights organizations claim that Palestinians from the Occupied Territories, who are in prisons and detention centres in Israel itself, are being held in violation of the Fourth Geneva Convention of 1949. Israel consistently maintains that this constitutes a legitimate exercise of its legal rights as the Occupying Power under the Convention.

For example, in 1977 a few hundred Palestinian prisoners were released on the occasion of religious festivals, and in 1985 some 1500 Palestinian political prisoners were released in exchange for three Israeli soldiers held by the PFLP (Palestinian Front for the Liberation of Palestine—General Command) of Ahmad Jibril.

Indeed, during certain periods, the numbers of Palestinians held in custody by the Israeli Army were much higher than those held in civil custody. For example, in 1989, during the peak year of the Intifada, some 4000 Palestinian prisoners were held in the IPS prisons and nearly 9000 were imprisoned in various army prisons and detention centres (Cohen, 1989: 194).

An examination of the breakdown of Palestinian security prisoners accord- ing to a more detailed classification of offences shows that in 1993, 56.7 per cent were convicted for terrorist/hostile activity, 27.5 per cent were convicted for violations involving membership in an illegal organization, 5.2 per cent were convicted for production, possession or throwing an explosive, a grenade or a Molotov cocktail and 3.8 per cent were convicted for causing death. No corresponding data have been published for later years.

Palestinian sources provide much higher numbers. For exam- ple, The Palestinian Prisoner Society reported that upwards of 10,000 Palestinians were arrested throughout the course of the military reoccupation of Palestinian cities in April 2002, 5000 of whom remained in detention centres.

Rape (Section 345 of the Penal Law) – Generally, rape is punishable by 16 years of imprisonment. Rape consists of intercourse with a woman (1) without her consent, (2) with consent which was obtained by deceit in respect of the identity of the person or the nature of the act, (3) with a minor who is less than 14 years of age, regardless of whether the victim consented or not, (4) by exploiting the woman's state of unconsciousness or other condition that prevents her from giving her free consent, or (5) by exploiting the fact that she is mentally ill or deficient, if – due to her illness or mental deficiency – her consent was not given freely. However, the maximum penalty for rape is increased to 20 years, if committed in the following cases: (a) if the victim is a minor under the age of 16, under the circumstances set forth in items ((1), (2) (4) and (5) above, (b) if the act was committed under threat of a firearm or other weapon; (c) if it was committed by causing physical or emotional harm, or pregnancy, (d) if abuse was committed before, during or after the act, or (e) if it was committed in the presence of one or more persons, who joined together in order for any of them to commit the act.

Forbidden intercourse despite consent (Section 346 of the Penal Law) – if a person has intercourse with a minor between the ages of 14 and 16 who is not married to him , or if a person has intercourse with a minor between the ages of 16 and 18 by exploiting a relationship of dependence, authority, education or supervision, or by a false promise of marriage, then that person is liable to five years imprisonment.

Die Studie kam zum Ergebnis, dass 62,8 Prozent der Frauen im Alter zwischen 18 und 64 Jahren in den zwölf Monaten vor der Befragung in einer Form Gewalt erlebt haben. Knapp die Hälfte von ihnen (48 Prozent) hatte psychologische Gewalt erfahren. Dazu gehören Handlungen mit dem Ziel, die Frau zu dominieren, zu isolieren oder sie zu erniedrigen.

15 Prozent der Frauen gaben an, in den zwölf Monaten vor der Befragung physische Gewalt erlebt zu haben. Dabei ist diese Form der Gewalt in den Städten rund doppelt so verbreitet wie in ländlichen Gebieten. Insgesamt gut ein Drittel der Frauen (35,3 Prozent) sagten, dass sie mindestens einmal in ihrem Leben als Erwachsene physische Gewalt erfahren haben.

Von den verheirateten Frauen haben 6,4 Prozent in den zwölf Monaten vor der Befragung physische Gewalt in ihrer Ehe erlebt.

Knapp ein Viertel (23 Prozent) aller Marokkanerinnen, also rund 2,1 Millionen Frauen, haben gemäss der Studies des Haut-Commissariat au Plan mindestens einmal in ihrem Leben in einer Form sexuelle Gewalt erlebt.

Dabei sind im urbanen Umfeld die Frauen dreimal häufiger betroffen als auf dem Land. In den zwölf Monaten vor der Befragung wurden 8,7 Prozent oder 827‘000 Frauen Opfer sexueller Gewalt.
