JUST IN: MSNBC admits defeat, says Fani Willis will be disqualified because she allegedly “lied to the court.”

“This is epic, this is monumental... Fani Willis lied to the court, it’s game over for her. She will be disqualified.”

MSNBC was reacting to statements from Willis' former friend Robin Yeartie who said she has no doubt Willis and prosecutor Nathan Wade had a “romantic” relationship in 2019 & on.

This suggests Willis lied to the court when she claimed there was no romantic relationship in 2021 between the two.

“You have no doubt that their romantic relationship was in effect from 2019 until the last time you spoke with her?” attorney Ashleigh Merchant asked.

“No doubt,” Yeartie replied.

As I understand the possible consequences under GA law, a DQ of Willis would automatically DQ the entire Fulton County DA's Office.

The case would then have to be taken over by a different GA DA. I'm not sure what process is involved in that re-assignment, whether it would be by the State AG or by a supervising Court.

I don't know if the case would move out of Fulton County to the County where the other DA is located.

But it certainly will derail the case for months if not a year or more.

It would also open the case up to re-evaluation as to its legal merit and factual strength by the new DA.

As a GENERAL PROPOSITION -- when a Judge is inclined to rule against a particular participant, that Judge allows the participant to say pretty much anything and everything he/she wants. It's called "protecting the record."

What that does is cut-off the losing party from being able to claim "You didn't give me a chance to say everything I wanted to say, blah, blah, blah."

All it really does is eat up time, but the extra time spent in the hearing is a small fraction of what would be required if the judge was reversed and the matter had to be done over again.

I suspect that if Judge McAfee was of the opinion that Willis' conduct was simply unprofessional and unethical, but not disqualifying -- taking the worst case spin on everything presented by the defendants -- he would not be allowing his to grind on with Willis on the stand. But to let her say everything she wants to say, he has to let the questioning continue.
