⚠️ youtube-dl - Copyright Violations ⚠️

October 23, 2020

GitHub

Dear Sir or Madam:

I am contacting you on behalf of the Recording Industry Association of America, Inc. (RIAA) and its member record companies. The RIAA is a trade association whose member companies create, manufacture or distribute sound recordings representing approximately eighty-five (85) percent of all legitimate recorded music consumption in the United States. Under penalty of perjury, we submit that the RIAA is authorized to act on behalf of its member companies on matters involving the infringement of their sound recordings, audiovisual works and images, including enforcing their copyrights and common law rights on the Internet.

Copyright Violations. We have learned that your service is hosting the youtube-dl source code on its network at the following locations, among others:

Amazon refuses to appear before Indian parliamentary panel on data privacy

Representatives of Amazon.com Inc in India have refused to appear before a parliamentary panel reviewing the country’s privacy bill, an Indian lawmaker said on Friday, an allegation the U.S. commerce giant said was a result of a misunderstanding.

India has been drafting several regulations for the technology sector which industry executives say could hurt investment plans of foreign technology giants.

The Indian government is also considering a new policy for the e-commerce sector and to regulate so-called “non-personal” data.

An Update to Patreon’s Policies on QAnon

Today we are taking a step to address the QAnon conspiracy theory on Patreon. Going forward, creator accounts that advance disinformation promoting the QAnon conspiracy theory will no longer be supported on Patreon.

Why are we taking this action?

While Patreon does not propagate this content directly, there are a small number of creators on the platform who have supported the QAnon conspiracy theory with their work. Because of this, and the fact that we have seen a number of other online platforms become overrun with pages and groups actively focused around QAnon disinformation, we are taking action. In an effort to assess and combat this growing threat, Patreon’s Policy and Trust & Safety teams have individually identified the creator accounts that have engaged in spreading QAnon-supporting disinformation.

Asking Microsoft to resign from the RIAA over youtube-dl takedown demand

We learned on Friday that GitHub removed youtube-dl's primary collaboration forum and code repository from their site, which had been hosted at https://github.com/ytdl-org/youtube-dl. The action was in response to a DMCA Section 512 notice that the RIAA sent demanding removal of youtube-dl, which was released and distributed via GitHub under a liberal FOSS license. In the notice, the RIAA cites DMCA Section 1201 (the removing digital restrictions section) as justification for youtube-dl's removal.

We believe that youtube-dl has substantial non-infringing uses. There are many, but to name a few, youtube-dl has the following important features:

enable users to watch YouTube videos without installing any non-free software

— watch YouTube at different speeds (including speeds YouTube does not offer) — an important feature for accessibility!

change the YouTube video quality setting manually when the user is more aware of bandwidth issues than YouTube's non-human algorithms

ability to download (and then, with other software, modify and reuse) freely licensed videos, such as those licensed under CC-BY

We realize Microsoft, a paying member of the RIAA, has left themselves stuck between their industry association's abuses of the law and the needs of FOSS projects for which they provide infrastructure. While under current law (which we object to), complying with the takedown notice is admittedly the fastest way to limit Microsoft's liability, we view Microsoft's membership in the RIAA as a much bigger liability to our community, now that Microsoft controls GitHub. We call on Microsoft to resign from the RIAA and remove their conflict of interest in this matter. This is an important opportunity for Microsoft to stand up for the values of software freedom.

If you work at Microsoft (including for its GitHub subsidiary), we call on you to petition your employer to resign immediately from the RIAA. We suggest that you raise these concerns directly with your manager or other management, or (even better) by starting an internal email petition with other employees.

To build a strong community of FOSS developers, we need confidence that our software hosting platforms will fight for our rights. While we'd prefer that Microsoft would simply refuse to kowtow to institutions like the RIAA and reject their DMCA requests, we believe in the alternative Microsoft can take the easy first step of resigning from RIAA in protest. We similarly call on all RIAA members who value FOSS to also resign.

Poll results: ZDNet readers find Google guilty of antitrust, but no consensus on remedies.

By an overwhelming margin, respondents to our latest ZDNet poll agree with the government's decision to file antitrust charges against Google. But how to cure the problem is another story. And just what does Buffy the Vampire Slayer have to do with all this?

Last week we asked ZDNet readers to weigh in on the decision by the U.S. Government and 11 state attorneys general to file antitrust charges against Google. Do you think Google is guilty? And if so, what do you think is the best remedy?

In all, we received 1023 responses. It's worth noting right up front that this isn't a scientific survey, so treat the results as interesting but not necessarily an accurate representation of general public opinion.

Apple develops alternative to Google search.

Apple may build its own search tools as ties to Google come under antitrust scrutiny.

Apple is stepping up efforts to develop its own search technology as US antitrust authorities threaten multibillion-dollar payments that Google makes to secure prime placement of its engine on the iPhone.

In a little-noticed change to the latest version of the iPhone operating system, iOS 14, Apple has begun to show its own search results and link directly to websites when users type queries from its home screen.

That web search capability marks an important advance in Apple’s in-house development and could form the foundation of a fuller attack on Google, according to several people in the industry.

Japanese Hentai Is Now Banned in Australia

The comics are now regarded as “illegal pornography,” following fears of child porn being brought into the country.

Australian authorities are reportedly cracking down on the importation of hentai from Japan, signalling the latest measures in the nation’s increasingly hardline stance on the sexually explicit comics.

Japanese adult retailer J-List—which specialises in the sale of sex toys, anime, cosplay, figurines and manga—posted a statement to their website earlier this month claiming that Australia’s Border Force (ABF) and customs had started blocking all their adult products from entering the country.

This includes pornographic hentai, Japanese porn videos, sexually suggestive figurines of anime characters, onaholes—that is, an artificial vaginas designed for masturbation—and any other product marked with a “+18” symbol. As a result, J-List has been advised to stop shipping to the country.
