Good morning, all. I have been spending some time trying to understand how HOAs are/were formed and what influences/guides their governing structures/systems. In particular, what federal influences are/were involved … and what US Congressional laws, if any, exist to better understand how HOAs formulate/use their power. I am not a lawyer by any stretch, but I am interested in connecting dots to better understand things.
I came across this Uniform Common Interest Ownership Act. Perhaps others can glean something from it. Appears to be crafted by “experts” vs referencing a law/laws enacted US Congress … not sure I’m correct on that or if this is irrelevant. Thoughts or opinions? Says the Act assists states in creating uniformity, at a federal level. I wonder if my HOA mgmt and/or the developer reference(d) it.
