К настоящему моменту сложилась такая ситуация, что мы не ратифицировали протокол Конвенции по правам человека, который закреплял отмену смертной казни, то есть мы только заявили, что к нему присоединяемся. Само правило отмены высшей меры наказания регулируется именно этой Конвенцией и протоколом №6 к ней, к которому мы когда-то присоединились, но в октябре 2022 года Россия из нее вышла. То есть, по сути, в настоящее время международных договоров, обязывающих к чему-то Российскую Федерацию, нет.
