The Union government has opposed petitions seeking an income-based โcreamy layerโ exclusion within Scheduled Caste and Scheduled Tribe quotas.
In an affidavit filed in the Supreme Court, the Ministry of Social Justice and Empowerment stated that the creamy layer principle applies only to Other Backward Classes (OBCs), as clarified in previous Constitution Bench rulings including Indra Sawhney (1992) and Ashoka Kumar Thakur.
The Centre argued that SC/ST reservations address historical social disadvantage, not purely economic criteria. Any change to introduce income-based filters would require a comprehensive empirical review and fall within the domain of Parliament, not the judiciary.
The government has urged the court to dismiss the pleas.
