Review of financial records revealed that one thousand and seventy-seven (1,077) transactions in the Integrated Financial Management Information System (IFMIS) amounting to Kshs.1,575,676,547 were voided by the County Executive during the year.
However, supporting documents such as voided payment vouchers, requests to void the payments, The National Treasury approval and Exchequer requisitions to the Controller of Budget were not provided for audit review.
Further, the voided payments were not disclosed as pending accounts payable and the utilization of the funds meant for thevoided transactions was also not confirmed.
In the circumstances, the accuracy and completeness of financial statements and the authenticity of the voided transactions amount of Kshs.1,575,676,547 could not be confirmed.

Mike Mayo Gumo, son of former Kitale East Member of Parliament Fred Gumo, has been exposed for orchestrating a multimillion fraudulent scam within the Nairobi City County government.
The scandal centers on an unauthorized Local Purchase Order (LPO) issued by Mike Gumo, the current Nairobi City County Executive Committee Member in charge of Innovation and Digital Economy.
The LPO numbered 0015995 sanctioned the purchase of sixty (60) Samsung Galaxy S23 ultra mobile phones at an exorbitant price of Ksh. 375,000 each.
Investigations have revealed that the LPO was a forgery masterminded by Mike Gumo himself.
Equipelt Enterprises delivered the mobile phones under the fraudulent requisition and now risks a potential loss of Ksh. 20 million for the company.
Despite the victims reporting the matter to DCI, no action has been taken against Mike Gumo.
The petition filed by proprietors of M/s Equipelt Enterprises demands the return of the supplied mobile phones or a refund of the equivalent amount as well as the initiation of removal from office proceedings against Mike Gumo for abuse of office and gross misconduct in accordance with the County Governments Act, 2012.

116. Unconfirmed Legal Costs
The County Executive spent a total of Kshs.3,260,017 on legal services in respect of a Constitutional case between an ore mining company and the County Executive on disputed mining fees of Kshs.19,883,301, as a result of the County charging the rate of Kshs.1,000 instead of Kshs.150 per tonne of ore. The case was ruled against the County Executive whose rates were found to be excessive and was therefore ordered to revert to the previous rate of Kshs.150 per tonne of ore.
However, the status report on legal payments made as required by Public Sector Accounting Standards Board reporting guidelines on asset and liability management in the public sector was not provided for the audit. Therefore, it was not possible to determine the total legal payments made as a result of the dispute in the case since it was filed in court. Further, included in the list of pending bills as at 30 June, 2023, is an amount of Kshs.3,260,018 due on legal costs for the same case. There is a likelihood that the County Executive will make legal payments in excess of the disputed amount.
In the circumstances, value for money on the expenditure relating to the legal dispute on mining fees of Kshs.3,260,017 could not be confirmed.
