““Everyone who believes in the First Amendment and a free press should be dismayed that the federal prosecutors continue to conceal facts about their investigation into a free press over the President Biden’s 40 year-old daughter's diary.  A separate news outlet published the diary a year ago, and it remains on the internet today. That's why it's troubling that the government persuaded the magistrate that there were “privacy interests” at issue -- anyone with an internet connection can go and read the journal and what it says about Joseph Biden. The magistrate's order observed that the diary belongs to someone who "happens to be the daughter of President Biden." That's what makes the government's attack on the press so alarming.  It is not clear that any grand jury has actually heard evidence on this matter -- search warrants can be entirely unrelated to any evidence taken by a grand jury. Federal prosecutors likely presented incomplete and misleading “facts” to convince the magistrate into authorizing the search warrant -- including their mendacious argument that the use of Telegram, a popular free app that Project Veritas and almost most other careful, mainstream news outlets and journalists use, is somehow indicative of wrongdoing because it is encrypted. Would federal law enforcement attack the press like this if it were investigating the diary of a person without the last name "Biden?” Also, the magistrate’s rationale pretty clearly means that anytime a good journalist seeks or receives information over which someone asserts a vague “privacy interest,” the journalists hands are tied to a degree.  And I find that very troubling because that’s what good journalists like James O’Keefe do – expose information people want kept private.  Transparency and sunshine are the best disinfectants. The SDNY USAO and FBI should stop slinking around and parsing their words carefully and instead pull back the curtain of their great diary investigation and show the world why they are on a mission to desecrate the First Amendment and a free press.” - O’Keefe lawyer Paul Calli
