Fiduciary ethics dictate that clients can waive potential conflicts of interest, but you still have to make an evaluation about the likelihood of those conflicts presenting themselves and harming the client.
When the conflict of interest is not potential, but instead abundantly apparent, as in the case of FTX, the fiduciary cannot simply accept a client’s waiver of it. And they certainly cannot pressure the client to waive it.
