The primary aim of the Department of Ex-Servicemen Welfare (DESW) is the welfare, resettlement, and rehabilitation of ex-servicemen (ESM), war widows, and their dependents.

However instead of ensuring quick and effective resolution of grievances related to pension, healthcare, and other issues of ESM through a robust mechanism, the department most of time acts as if ESM and DESW are on different sides of the Radcliffe Line.

Primarily because of DESW, the Central Government files cases against disability benefits granted to soldiers by the Armed Forces Tribunal (AFT). In fact  the High Court of J&K and Ladakh has recently dismissed a bunch of about 40 such appeals filed by the Central Government.
 
When the AFT summoned the secretary DESW, in a particular order, he repeatedly insisted that his department was not concerned in the matter, for non-implementation of an order of AFT, thus trying to wash his hands off responsibility.

In the past also, secretary DESW violated direction to appear before the court on two separate occasions without proper justification, following which a notice for contempt was issued and the secretary as well as the Additional Director General, Personnel Service in Army Headquarters were asked to file affidavits explaining their respective stance on the powers of implementing court orders.

“Denial of responsibility by the apex-level authority reflects very poorly on his leadership qualities. It reveals that even a Secretary-level officer of the Government of India can stoop to the level of denial of responsibility simply to shift blame on somebody else,” the Bench observed.

Solution: Reduce bureaucratic involvement in defence affairs by appointing retired Lieutenant Generals to key positions such as Secretary of Defence and all other senior defence-related administrative roles.
