1. It's the first step towards permanent residency

The 820 visa is the onshore (you must be in Australia) temporary stage of the Partner visa pathway. If granted, it lets you stay in Australia while you wait for the 801 permanent Partner visa decision which usually takes 2+ years.

2. You must be in a genuine and continuing relationship

To qualify, you must be either:

Married to your partner, or

In a de facto relationship for at least 12 months

OR less if you've registered your relationship in an eligible state/territory).

You must prove your relationship is real and ongoing through shared finances, joint commitments, household evidence, and social recognition.

3. You must be on a valid visa in Australia when you apply

You must hold a substantive visa (like a student or visitor visa) when you lodge your 820 application, not a bridging visa.

4. You can include dependents in your application

Your children can be added to your 820 visa application as secondary applicants they'll be granted the same visa as you.

5. You must meet character and health requirements Even though it's a partner-based visa, the Department of Home Affairs still assesses your character and health.
