Canada has updated its visitor visa policies, ending the automatic issuance of 10-year multiple-entry visas. The Immigration, Refugees and Citizenship Canada (IRCC) announced that the maximum-validity multiple-entry visa will no longer be the standard option. Previously, visitors could receive 10-year multiple-entry visas, allowing free re-entry during that time. Now, visa officers will evaluate each application individually, considering factors such as the purpose of the visit, financial resources, health, and ties to the home country. For multiple-entry visas, officers can set shorter validity periods based on factors like the visit's purpose, an applicant's status in their current residence, and political or economic stability in their home country.

The LMIA Process

Step 1: The employer applies for LMIA
The first step in the LMIA process is for the employer to apply for an LMIA from Employment and Social Development Canada (ESDC). The employer must demonstrate that they have made reasonable efforts to hire a Canadian or permanent resident for the position and that no qualified candidates were found.

Step 2: Job Offer and Contract
Once the LMIA is approved, the employer can extend a job offer to the foreign worker. This job offer must include a detailed contract outlining the terms and conditions of employment, including wages, working conditions, and duration of employment.

Step 3: Work Permit Application
With the LMIA and job offer in hand, the foreign worker can then apply for a work permit. This application is submitted to Immigration, Refugees and Citizenship Canada (IRCC).

Step 4: Arrival in Canada
Once the work permit is approved, the foreign worker can travel to Canada and begin their employment. The work permit is typically tied to the specific employer and position for which the LMIA was obtained.
