NATIONAL SECURITY NON-DISCLOSURE AGREEMENT
SPECIAL ACCESS / COMPARTMENTED INFORMATION
I, ______________________________, acknowledge that by virtue of my position, assignment, clearance, or participation in activities affecting the national security of the United States, I may receive access to classified, compartmented, operational, intelligence, technological, military, or otherwise restricted information.
I understand that such information may concern ongoing military operations, intelligence sources and methods, advanced technologies, special-access programs, communications systems, foreign governments, cooperating forces, personnel identities, locations, facilities, capabilities, vulnerabilities, or other matters whose unauthorized disclosure could cause grave or exceptionally grave damage to national security.
1. NON-DISCLOSURE
I will not knowingly disclose, transmit, reproduce, publish, discuss, confirm, deny, or otherwise make protected information available to any unauthorized person.
2. NEED TO KNOW
Possession of a security clearance alone does not constitute authorization to receive compartmented information. Access shall be restricted to persons possessing both appropriate authorization and an established need to know.
3. COMPARTMENTALIZATION
Information obtained within one compartment, operation, program, or special-access environment shall not be transferred into another except through specifically authorized channels.
4. COMMUNICATIONS SECURITY
I will not knowingly place protected information onto unauthorized computers, telephones, networks, cloud services, recording devices, artificial-intelligence systems, removable media, or other unauthorized communications or storage systems.
5. CONTINUING OBLIGATION
My obligation to protect classified or lawfully restricted information continues after my assignment, employment, clearance, contract, military service, or participation in the operation has ended, for as long as the information remains legally protected.
6. NATIONAL-SECURITY AND WARTIME PENALTIES
I acknowledge that unauthorized disclosure of protected national-security information may subject me to loss of clearance or access, removal from assignment, administrative action, contractual remedies, and civil or criminal prosecution under applicable law.
I further acknowledge that an unauthorized disclosure made for the purpose of assisting a foreign power, an enemy of the United States, or another hostile actor may constitute substantially more serious criminal conduct when the facts independently satisfy the elements required by law.
Nothing in this agreement makes a breach of this agreement, standing alone, an act of treason or a war crime.
However, I acknowledge that conduct associated with an unauthorized disclosure could, depending upon the circumstances and applicable jurisdiction, be prosecuted under statutes governing espionage, unlawful disclosure of classified information, treason, or other national-security offenses. Conduct occurring during armed conflict could also give rise to liability under applicable military or international criminal law where the independent legal elements of such an offense are established.
I acknowledge that treason against the United States is constitutionally defined and carries extraordinary evidentiary requirements, and that federal law provides penalties that can include imprisonment and, in legally qualifying circumstances, death.
I further acknowledge that certain offenses under the law of armed conflict or military law may carry severe criminal penalties, potentially including death where expressly authorized by applicable law and constitutionally permissible.
BY SIGNING THIS AGREEMENT, I ACKNOWLEDGE THAT DELIBERATE UNAUTHORIZED CONDUCT INVOLVING NATIONAL-SECURITY INFORMATION MAY EXPOSE ME TO THE FULL RANGE OF PENALTIES AUTHORIZED BY LAW, INCLUDING, FOR INDEPENDENTLY ESTABLISHED DEATH-ELIGIBLE OFFENSES, THE POSSIBILITY OF CAPITAL PUNISHMENT.
I understand that neither this agreement nor any official administering it possesses authority to create a criminal offense or punishment that is not otherwise established by law.
7. REPORTING REQUIREMENT
I will immediately report any known or suspected unauthorized disclosure, compromise, loss, attempted acquisition, or improper handling of protected information through designated security channels.
8. PROTECTED AND LAWFUL DISCLOSURES
Nothing in this agreement authorizes the concealment of unlawful activity or eliminates disclosure rights and protected reporting channels established by federal law, including authorized communications with inspectors general, Congress, law-enforcement authorities, or other officials designated by law.
9. RETURN OF MATERIAL
Upon demand or termination of my authorized access, I will surrender all classified or restricted materials in my possession and retain no unauthorized copies, extracts, photographs, recordings, notes, or reproductions.
10. SOLEMN ACKNOWLEDGMENT
I acknowledge that access to national-security information constitutes a position of extraordinary trust. Unauthorized disclosure may jeopardize military operations, intelligence personnel, cooperating forces, technological capabilities, or the national security of the United States.
I have read this agreement, understand its obligations, and acknowledge that deliberate violations may result in prosecution and the maximum punishment authorized by applicable law.
