‘The necessity could not be starker’

Fears for the Emirati hospital are particularly acute. This is one of the last partially functioning maternity hospitals in the whole of Gaza which was until recently handling almost half of Gaza’s daily total of 180 births.
It has already been forced to stop admitting patients and medics warn that without a doubt every single one of the 45 babies in the neonatal intensive care unit and the special intensive care unit will day if the hospital is occupied.
And then on May 13, medical staff at the Kuwaiti received an evacuation order from Israeli forces. As one of the last remaining hospitals in Rafah, it had only around 16 beds available for the more than one million people sheltering in Rafah. Its closure will mean the complete collapse of the limping healthcare system in Rafah.
Israel’s ground incursion into Rafah has been described by the UN as one of the darkest morning in this seven-month nightmare.
With Rafah’s destruction ongoing as South Africa speaks to this court today, the destruction of Gaza itself will be complete.
The change in the situation in Gaza and the new facts in Rafah that I have described demand the provisional measures.
The necessity could not be starker. The magnitude and the gravity of the situation facing the Palestinian people in Gaza is now exemplified in Rafah.
South Africa has thus been motivated to come urgently to this court to prevent the destruction of the final Palestinian governorate of Gaza with its homes, its hospitals, its schools, its libraries, its businesses, shelters, mosques to which Israel has not yet laid complete waste.
South Africa has come quickly as possible to the court to ensure that the exhausted Palestinian men women and children who have sought refuge in Rafah are protected from a bloodbath.

Israel has continued to kill Palestinians in Gaza, including women and children, at an alarming rate.
As a result of Israel’s onslaught, Palestinians in Gaza are facing what the Undersecretary General of the UN has described as the worst humanitarian crisis he has seen in more than 50 years.
Israel’s systematic targeting and bombardment of hospitals and medical facilities and its throttling of humanitarian aid have pushed Gaza’s medical system to collapse.
Israel’s direct attack and siege of Gaza’s biggest hospitals has led to the uncovering of mass graves evidencing Israeli massacres of Palestinians seeking shelter and medical treatment.

South Africa ‘compelled’ once again to seek ICJ’s intervention
Irish barrister Blinne Ni Ghralaigh has now taken the floor. She opened by speaking in French.
She says that, in light of the dramatic developments unfolding in the Gaza Strip, “South Africa feels compelled to once again request your invaluable intervention.”
South Africa, she says, also calls on the court to “modify or indicate new provision measures, in particular, and explicitly an immediate secession of Israeli military operations in Rafah and everywhere else in the territory, in order to protect and also to prevent the total annihilation of what remains of the Gaza Strip of Palestine and of its people”.

‘Without Rafah, there is no more Palestinian life in Gaza’
Professor Ngcukaitobi concludes his presentation by saying:
The genocidal acts described in South Africa’s application were foreseen and foreseeable from the onset. Israel’s intent was always to destroy Palestinian life and to wipe them off the face of the Earth.
Rafah is the final stand. Without Rafah, there is no more Palestinian life in Gaza to speak of, no more Palestinian identity and no possibility of reconstruction.
The rule of law can only survive through the orders of this court. If the rule of the law is to have any meaning, let it be today and with this case.
It is no longer enough to order unhindered access to humanitarian aid when it is in fact the military operation in Gaza that is preventing it.
It is no longer enough to encourage compliance … with the Genocide Convention when Israel’s deliberate contempt for the international rule of law has been so plain and so public.

Israeli soldiers, officials understand goal as ‘destruction of Palestinian life’
Ngcukaitobi has gone through a series of statements by high-level Israeli officials, including the vice-chairman of the global arm of Israel’s leading Likud party, that he says show “genocidal intent” in Gaza.
He has also displayed to the court a video of Israeli soldiers echoing such calls, including one of a group of soldiers yelling: “Let’s go and destroy Rafah.”
“The destruction of Palestinian life in Gaza is understood by Israeli officials and soldiers,” Ngcukaitobi said.

Israel immediately ceases military operations in Gaza, including Rafah, and withdraws from the Rafah crossing.
Israel lets officials from the UN and other bodies providing humanitarian aid into Gaza. Israel ensures the unimpeded access of fact-finding missions, internationally mandated investigators and journalists to document and preserve evidence on the ground.
Israel submits open reports to the court on:
All measures taken to give effect to these provisional measures within one week from the date of the order
All measures taken to give effect to all previous provisional measures indicated by the court within one month of the order.

South Africa warns former colonial powers of ‘genocide denial’
In his final remarks, South African Ambassador Madonsela also warned of the dangers of former colonial powers denying genocide as Israel continues its onslaught in Gaza.
“Israel is acting with complete impunity in Gaza, escalating a final wave of… destruction from which there is no return”, said Madonsela.
“Three is a danger that sems from a form of amnesia and denial by former colonial powers in relation to the crimes associated with colonial violence perpetrated by indigenous peoples,” he said.
This includes the denial of genocide. This denial is clearly at play in Palestine.”

South Africa’s remarks at today’s hearing showed much stronger language “not only in the demands and end immediately and withdrawal of fighting forces, but it asserts quite clearly that there is genocidal intent on the part of Israel”, human rights lawyer Geoffrey Nice told Al Jazeera.
In the earlier hearings, South Africa appeared to take a softer approach, even to Israel, due to the October 7 attacks he said.
However, now, Nice noted, “it is making it quite clear that there’s evidence that Israel really has genocidal intent to destroy the Gaza and people in Gaza altogether”.
He said the court still can’t make a determination of genocide until all the evidence is heard at the end of the overall case.
“What it may do is identify a far stronger risk of genocide against which it needs to give its protection” he said, which may lead to it granting the protective measures that South Africa has requested.
