Who is Hamas

Hamas, which means "zeal" in Arabic, is a Palestinian political and militant group.

It was founded in 1987 during the First Intifada (Palestinian uprising) against Israeli rule in the occupied territories.

Formation:
Hamas was established as an offshoot of the Muslim Brotherhood, a Sunni Islamic organization founded in Egypt.

It rapidly gained support among Palestinians for its combination of nationalist resistance to Israeli occupation and its provision of social services.

Charter and Ideology:

In 1988, Hamas issued its charter, which combined Islamic principles with Palestinian nationalism.

However, in 2017, Hamas issued a new document that, while still not recognizing Israel's right to exist, omitted some of the more inflammatory language of the original charter.

Leadership and Structure: Hamas has both a political and a military wing. Over the years, the leadership structure has evolved.

Notable leaders of Hamas have included:
Sheikh Ahmed Yassin: One of the co-founders of Hamas.
He was the group's spiritual leader until his assassination by Israel in 2004.

Abdul Aziz al-Rantisi:
Another co-founder and leader who became the head of Hamas after Yassin's death but was assassinated by Israel shortly after in 2004.

Khaled Meshaal:
Formerly based in Damascus, Meshaal was the long-serving head of Hamas's political bureau. He has since stepped down from his leadership role.

Ismail Haniyeh:
Formerly the Prime Minister of the Palestinian Authority after Hamas's 2006 election victory. He later became the leader of Hamas's political bureau.

Yahya Sinwar:
Elected in 2017 as the leader of Hamas in Gaza. He's considered one of the more hardline figures within the organization.

Activities:
Hamas is known for its resistance against Israeli rule, which has included suicide bombings, rocket attacks, and other forms of operations against Israeli military targets.

It's also engaged in various conflicts with the Fatah party, which leads the Palestinian Authority.

In addition to its militant activities, Hamas provides social services, operates schools, hospitals, and religious institutions in the areas it controls.

Hamas is also recognized as a legitimate resistance movement by many other countries and international actors.

The organization's dual role as both a political and militant entity has made it a central, yet contentious, player in the Israeli-Palestinian conflict and Palestinian politics.

Do you take them as terrorists of resistance fighters against the Zionist occupation, oppression, colonialism, settlements ethnic cleansing, genocide since 1948?

Designation as a Terrorist Organization:

Hamas is designated as a terrorist organization by Israel, The United States and Canada.

Resistance:
In public international law, the concept of resistance and liberation movements is explicitly mentioned in international humanitarian law with references in the Geneva Conventions and their Additional Protocols.

What is armed resistance under international law?

Armed resistance is a concept that individual citizens are rising up to defend their own country from any kind of a military incursion or effort to subordinate their sovereignty by picking up arms and perhaps in support of or in tandem with the regular armed forces of the country.

According to international law, states may not use force against the lawful exercise of self-determination, while those seeking self-determination may use military force if there is no other way to achieve their goals.

Armed resistance against the occupying power is a fact that is acknowledged by international humanitarian law conventions, which protect the participants in such activities as long as they comply with certain requirements regarding the entitlement to the prisoner of war status.

What is resistance to occupation?

After effective occupation of territory, members of the territory's armed forces who have not surrendered, organized resistance movements and genuine national liberation movements may resist the occupation.
