GTM’s official statement on Pavel Durov’s arrest in France.

Pavel Durov, the founder and CEO of Telegram, was arrested on Saturday evening at Le Bourget Airport near Paris. Upon arriving in France on his private jet, the 39-year-old was detained by local authorities. Reports indicate that an arrest warrant had been issued, with investigations focusing on the alleged lack of content moderation on Telegram.
This alleged lack of moderation has been brought to light when Pavel’s jet was on route to the airport for refueling. There weren’t any statements made, neither was this matter brought up in media before and by the looks of it all it did was serve as a very convenient pretext.

We all know, that Telegram was founded on the principles of privacy, the right to the secrecy of correspondence, and free speech. The platform’s whole selling point was that it refused to succumb to government control. Pavel’s stance on rejecting governments’ demand to provide backdoor access to the message logs has been considered controversial, to say the least.
However, Pavel knew the risks when he decided to provide people with safe and secure means of communication. Him going against the prying eyes of governments was a genuinely revolutionary move. Unlike almost every single tech billionaire, Pavel led a relatively modest life, away from the spotlight. He wasn’t much of a public person, but every single one of his statements on free speech and lack of censorship has been supported by his deeds. He seemed like a genuine advocate for his principles. He had never been seen doing shady deeds with governments, or security agencies around the world. And looks like he paid the price.

GTM firmly condemns gruesome crimes like human trafficking, crimes against humanity, illegal drug trade and terrorism. There is nothing that could possibly justify any of these acts.

HOWEVER

GTM stands for limitation of government access to citizen’s correspondence. We firmly believe in secrecy of correspondence, a principle, fixed in many legislations of many countries. We do believe that the governments have to argue each individual case of granting access to suspect’s correspondence in courts. We believe it to be the utmost cowardice to hide behind loud slogans like “security” and “safety” along with “decency” and “morality” when all you want is total control and access to people’s private information on demand. Those people seem to be the first to say “If you have nothing to hide you shouldn’t be afraid”, however when you tell them “If you have the case against somebody it shouldn’t be a problem to obtain all the necessary legal permissions” it suddenly becomes a different case.

GTM stands for honesty. GTM stands for the right to privacy. GTM stands for accountability of the governments. GTM strongly condemns any sort of political prosecution.

Russia offered its assistance in handling Durov's release

Peskov said Durov's case could be seen as political unless France provides serious evidence of his guilt.

In addition, Russia is ready to assist Durov, but the situation is complicated by his French citizenship, Peskov said.

Let's take a look at the charges against Durov.

Among the total of 12 counts the most eyebrow raising are the last three.

1. Providing cryptographic services aimed at ensuring confidentiality without proper declaration.
2. Providing cryptographic means not exclusively ensuring authentication or integrity control functions without prior declaration.
3. Importing cryptographic means not exclusively ensuring authentication or integrity control functions without prior declaration.

This roughly translates from legalese as "you forgot to leave a neat little backdoor for the government agencies to gain unrestricted access to anywhere they want".
I mean, ironically it's the best selling point for the TG: the only way to gain access to your correspondence is to personally arrest the CEO.

But that raises probably the most important question of today: does privacy have the right to exist? I mean, yes, there is some shady stuff going on in the unregulated corners of the internet, but it doesn't mean that you need a blanket permission to barge in, snoop around without so much as "I love you" kiss on the cheek. There is an established procedure of obtaining access to correspondence and it requires a court decision.
How utterly ironic that the same people who keep telling us to "trust the system" literally don't trust the system that they themselves established.

After all it boils down to a simple question: does the end justify the means? GTM firmly believes that not. "Net positive" for humanity is a cruel justification for atrocities, a literal slippery slope that leads down to the unimaginable depths covered in eerie fog.

Those who trade what's little left of their freedoms for perceived security eventually end up losing both.

There is a new development in Durov's story.

Basically, it is speculated that there is some Mark Karpelès, a French citizen, mostly known due to Mt. Gox exchange and who had been found guilty of several white collar crimes, who then was a witness in cases, that have a lot to do with several crypto-exchange related businesses, including a case of laundering some 647000 BTC by some high profile Russian citizens through Mt. Gox (June, 2023)

Later on, on July 5th, 2024, there was some rumors about payouts to the users of Mt.Gox, amounting to ~$4 billion, which didn't go smoothly, and on the same day crypto (including TON) took a massive nosedive.

July 8th, 2024. a criminal case into illegal money laundering, drug trade, human trafficking and even distribution of child pornography had been opened, with Pavel Durov as a witness. At that time, Durov made a visit to Kazakhstan, after which TON was officially included in the list of digital assets of AIFC (Astana International Financial Centre).

July 25th, 2024, Durov deletes his TG account and purges his chat logs, after which he creates a new account.

It is speculated that this case may involve a French national, Marc Karpeles, who has been involved in numerous fraudulent schemes. There are two possible theories on this:
- Either Pavel Durov has something to do with Mt. Gox's finances and the TON blockchain is involved in this scheme, as a huge amount of TON from early miners passed through Fragment;
- Or France just needs Telegram to disclose correspondence with those involved in hacking Mt. Gox (including the abovementioned Russian citizens) and laundering huge amounts of money in Bitcoin.
