Marijuana, despite state-level legalization in some areas, remains a Schedule I controlled substance under the Controlled Substances Act (21 U.S.C. § 812). The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) explicitly states on Form 4473 (required for firearm purchases) that marijuana use, even if legal under state law, disqualifies individuals from possessing firearms. This applies to both recreational and medical marijuana users. Penalties can include up to 7 years in prison for a single violation.
