The CLARITY Act aims to change that.
The bill would establish who regulates what:
→ The CFTC would oversee spot markets for digital commodities (including Bitcoin)
→ The SEC would retain jurisdiction over investment contract assets
→ Exchanges, custodians, and issuers would finally have clear legal frameworks to operate under
In May 2026, the Senate Banking Committee advanced the bill 15-9. It is now in line for consideration by the full Senate, but still needs to clear more steps in Congress before becoming law.
