ICAN's lawyers (led by Aaron Siri) accomplished something yesterday for America that no lawyer has been able to accomplish in over 100 years. They won a preliminary injunction in federal court securing the right to religious exemption from all vaccines for all schoolchildren in the entire State.
This is not a mere technicality win based on some random procedure, but a genuine win based on the actual constitution! This is THE legal precedent we've been waiting for, because it has the potential to change the entire nation if upheld on appeal.
The Court's words:
Minute Entry for proceedings before District Judge Halil S. Ozerden: Hearing on Plaintiffs’ Motion for Preliminary Injunction held on 4/17/2023. Court heard testimony and additional argument. For the reasons stated on the record, and to be more fully detailed in a written order to follow, the Court will grant Plaintiffs’ Motion.
From and after July 15, 2023, Defendants Daniel P. Edney, in his official capacity as the State Health Officer … their officers, agents, servants, and employees, and anyone acting in active concert or participation with them will be enjoined from enforcing Mississippi Code § 41-23-37 [Mississippi’s compulsory school vaccination law] unless they provide an option for individuals to request a religious exemption from the vaccine requirement.
The key to ICAN's success appears to be the plaintiffs' complaint wisely built upon multiple recent legal precedents upholding religious exemption from COVID-19 vaccination. ICAN lawyers argued that from a public health perspective, a medical exemption to vaccination has the same effect as a religious exemption, so the government must remain neutral between the two groups of people (medically exempt students and religiously exempt students). In other words, under the 1st Amendment the government cannot treat secular activity (medical exemptions) more favorably than religious activity (religious exemptions). The Mississippi federal judge agreed, and so the judge will issue a detailed written decision soon.
To the extent this favorable ruling is appealed, ICAN's lawyers are now well-positioned to navigate the appellate courts and limit Jacobson v. Massachusetts (the infamous 1905 Supreme Court decision legalizing mandatory vaccination without religious exemption). ICAN's win this week is that important, and an indicator of the massive shift that COVID-19 catalyzed in the way people and courts are seeing the injustice of mandatory vaccination.
