Landmark Jury Trial on Medical Accountability to Begin in Appleton, Wisconsin
What: The trial of Schara v. Ascension Health, et al(Case No. 2023CV000345) will address the alleged wrongful death of Grace Schara, a 19-year-old with Down syndrome, and the trial results could have broader implications for accountability in U.S. healthcare.
This is the first wrongful death jury trial in the country for a death listed as COVID-19 on the death certificate.  The unique claims in this case include medical battery and a declaratory judgment ruling regarding the DNR order and the order for three contraindicated medications – Precedex, Lorazepam, and Morphine.
When: June 2, 2025, is the first day of the trial, beginning with jury selection. The trial is expected to last three weeks.
Where: Outagamie County Courthouse, 320 S. Walnut Street, Appleton, WI 54911. The trial is open to the public. The New American is working with Children’s Health Defense to livestream the entire trial.  The judge’s media order is attached.
Who:
Plaintiffs: Scott Schara and the Estate of Grace Schara
Defendants: Ascension Health, St. Elizabeth’s Hospital, and individual medical staff members.
Why: The trial will examine allegations of negligence, lack of informed consent, and medical battery.  The plaintiff also seeks a declaratory judgment for the DNR order and medication combination that the plaintiff alleges killed his daughter.
This case could set a precedent for medical accountability and the rights of patients.
Media Availability: Scott Schara will be available for interviews immediately after the trial’s conclusion.
