It is logically and legally possible for DOJ and DoD personnel to cooperate on investigations and prosecutions. Military lawyers can be detailed to DOJ as Special Assistant U.S. Attorneys, and DOJ policy expressly allows sensitive investigations to proceed without public disclosure of their existence or progress before charges are filed. DOJβs Office of Legal Counsel stated in 2025 that the Posse Comitatus Act does not bar full-time details of military attorneys to serve as SAUSAs so long as they operate under civilian control and supervision. DOJβs own media-relations policy also says the Department generally will not confirm or comment on ongoing investigations before charges are public.
As a matter of law and operational common sense, highly sensitive national-security or law-enforcement matters can be coordinated without public reporting of all details. DOJ policy, FOIA Exemption 7 materials, and DoD OPSEC guidance all point in the same direction: disclosure can be restricted when it would interfere with enforcement, reveal techniques, expose sources, or compromise operations. That supports the proposition that silence does not equal inactivity.
You can find strong official support for the broader idea that military lawyers can be used as SAUSAs, including a DOJ OLC opinion from 2025 and DOJ postings showing SAUSA detail programs. I also found a January 2026 DOJ press release from the Western District of Tennessee explicitly stating that the βDepartment of War assigns 20 military lawyers to serve as Special Assistant U.S. Attorneys.β This shows this kind of staffing move is real in some districts.
The official record supports GuantΓ‘namo Bay as a real military-commission site, with the Office of Military Commissions listing GuantΓ‘namo Bay, Fort Meade, and CCTV sites as its facilities.
