If nothing is done, Articles 81, 82 and 330A will automatically trigger after the next Census, leading to the redistribution of the existing 543 seats purely based on population.

ANALYSIS & IMPACTS of the 3 Bills Introduced in the Lok Sabha by the Union Government

1. The Constitution (One Hundred and Thirty-First Amendment) Bill,2026 – Proposes to increase the Maximum Capacity of the Lok Sabha from 550 to 850 seats ; 815 for seats for States & 35 seats for Union Territories.

2. Delimitation Bill,2026 – The bill mandates the formation of a high-powered Delimitation Commission to oversee the process of redrawing the new 850 seats map using Census 2011 data.

3. The Union Territories Laws (Amendment) Bill, 2026 – Allows Reservation for 33% Women in Delhi, J&K and Puducherry Legislative Assemblies.

• Reminder – Only the First Bill is a Constitutional Bill requiring Special Majority while the other two are Ordinary Bill which needs a Simple majority, although if the First Bill is defeated the remaining two bills become toothless.

What does The Constitution (One Hundred and Thirty-First Amendment) Bill,2026 Amends?

1. Amend Article 81 – Article 81 limits Lok Sabha Upper limit at 550 seats. If amended Upper limits will be 850 seats.

2. End the Article 82 Delimitation Freeze – The existing Law stated that no readjustment could happen until the first census after 2026 (i.e 2027)

If Amended the restriction is removed and Delimitation can be carried forward with the 2011 Census data.

3. Implementing 106th Constitutional Amendment Act, 2023 – Article 330A reserves 33% Reservation for Women, including Horizontal Reservation on SC/ST seats under Article 330 in Lok Sabha & State Legislative Assemblies.

*Sunset Clause Article 334A – Article 330A triggers only after the First Census has been conducted after the passage of 106th Constitutional Amendment Act, 2023 (i.e 2027)

The Constitution (One Hundred and Thirty-First Amendment) Bill,2026 seeks to amend this allowing to use 2011 Census data to implement the Women Reservation.

4. Amend Article 170 – Unfreeze the Article 170 Cap that restricts the Upper limit of State Assemblies at 500 & Lower limit at 60 (exception for Goa, Mizoram, Sikkim under Article 371-I, Article 371-G, Article 371-F respectively)

The bill will lift the freeze on Delimitation of State Legislative Seats across India to implement Article 330A (Women Reservation)

5. Diluting the Power of Rajya Sabha in the Joint Sitting of the Parliament – As The Constitution (One Hundred and Thirty-First Amendment) Bill doesnot Amend Article 80, the number of the Rajya Sabha remains capped at 250 seats while Lok Sabha increases to 850 seats.

The power of balance between a LS & RS MP in such a situation will increase from 2.2:1 to 3.4:1

P.S. – Jointing Sitting of the Parliament can be called if there is disagreement on passage of a certain bill (excluding Money Bill) in either of the houses. Although Article 368 forbids calling the Joint Session of the Parliament for any Constitutional Amendment Bill. It has to be passed separately by 2/3 Super majority in both the houses.

What if The Constitution (One Hundred and Thirty-First Amendment) Bill,2026 fails to pass in the Parliament ?

1. No Implementation of 106th Constitutional Amendment Act, 2023 reserving 33% seats for Women until next Census data.

2. Article 81 stays with Lok Sabha capped at 550 seats

3. Article 82 stays which will trigger after 2027 Census unfreezing the Delimitation Exercise

So if Lok Sabha is capped at 550 seats and Census 2027 data is taken for Delimitation, each state seats will be readjusted according to the population reflecting in 2027 Census data. (i.e States with low TFR might lose seats based on population and vice-versa)

IMPORTANT –

1. Center is bound by the Constitution to conduct a Delimitation Exercise post 2026 using the latest Census data according to Article 82, unless a Constitutional Amendment further pushes to freeze the Delimitation Exercise in the future.

2. Delimitation Commision is an independent body appointed by the Hon'ble President of India whose decisions are bared from Judicial Reviews under Article 329, further under Section 10(2) of Delimitation Act,2002 its decisions are Final and Bounding.
