Clarity Act
Current status- postponed; to be considered for vote in September.
The bill passed the House in July 2025 but stalled in the Senate over competing committee drafts.
Major roadblocks include debates over illicit finance rules, ethics guardrails for crypto-holding officials, and securing the 60 votes required to overcome a filibuster.
The upcoming November 2026 midterms threaten the bill's survival as lawmakers prioritize campaigning over passing controversial legislation.
If the bill fails to pass during the post-election "lame-duck" session (Nov-Dec 2026), it officially dies at the end of 2026 and the legislative process must restart from scratch in 2027.
The SEC and CFTC temporarily bypassed this gridlock in March 2026 by issuing joint guidance that mirrors the bill’s core goals, such as defining asset categories and protecting network validators. The two agencies have said they are ready to make more rules if Clarity Act fails to pass.
The industry still needs the bill codified into law because the current agency rules act as a temporary band-aid and remain highly vulnerable to reversals by future administrations or federal courts.
