The Employment and Labour Relations Court has certified as urgent a petition challenging a government directive requiring State corporations to obtain clearance from the Head of Public Service before appointing chief executive officers.

The petitioner argues that the Executive Circular issued last year unlawfully interferes with a recruitment process governed by statute.

The Employment and Labour Relations Court in Nairobi has struck out a petition challenging the appointment of Kenya Revenue Authority Commissioner-General Adan Mohamed, ruling that the case was filed in the wrong court and should instead have been lodged before the High Court.

The Consumer Federation of Kenya had sued in the public interest over Mr Mohamed's appointment.
