Issue: The conditions under which a person, who has undergone religious conversion, may avail the statutory benefits granted to the members of the Scheduled Castes and Scheduled Tribes
Background: Issue arose due to a criminal case under ST SC Act and therfore a larger issue was required to be decided before deciding the main issue.
The law: Article 342(1) , Constitutional order of 1950 states that president has declared tribal groups state wise for the purpose of ST status.
Meaning Of Tribe: βTribe has been defined as a social group of a simple kind, the members of which
βspeak common dialect,
βhave a single government
β and act together for such common purposes as warfare.
β a common name, a contiguous territory, a relatively uniform culture or way of life and a tradition of common descent. Tribes are usually composed of a number of local communities e.g.
bands, villages or neighbourhoods and are often aggregated in clusters of a higher order called nations.
"Once a person belonging to a
Scheduled Tribe converts to another religion, ultimately through the passage of time, the customs, rituals and other traits of that particular tribe may fall into eclipse. If so, in such circumstance, it is proved that the person in question has completely renounced himself from the customs, rituals and other traits of his tribe, and has assimilated into the converted religion following the practices and customs of that particular religion, a reasonable
inference can be drawn that such a person shall not be considered a part of the tribe.
Meaning of Caste: βis a voluntary association of persons for certain purposesβ. It is a well defined yet fluctuating group of persons governed by their own rules and regulations for certain internal purposes it is a social group yet ultimately founded on hindu religion.
The law: No person who professes religion other than Hindu, sikh, budhist can claim schedule caste status (1950 presidential order power derived under Article 342(2)
Meaning of Professing a religion: (Article 25 relation)
Connotes to publicly declare or practice a religion. The essence of the word lies in the open avowal of oneβs religious beliefs in a manner discernible to the public at large. It is not merely a question of personal belief or private conviction, but requires an outward manifestation of oneβs faith.
Appraisal of facts:
The person in question was a pastor who preaches christianity and therefore publically declares that he is a christian therefore he is no more a SC status holder.
Fraud on the Constitution:
If any person converted to another religion and still claims to be hindu merely for the purpose of benefits is performing fraud on the Constitution.
Consequence of Reconversion: Status of SC is regained, if
i. Bonafide unimpeachable reconversion to hindu, sikh budhism; And
ii. Acceptance by community.
-All these conversion questions are factual.
- SC status is removed the moment conversion (profess) is done.
- ST status is not dependent on comversion but on withering of tribal identity which maybe due to comversion or otherwise.
