The Delhi High Court applied this doctrine in the case of India TV Independent News Service vs Yash Raj Films. The court was considering a case where, on the chat-show INDIA BEATS, a guest sang portions of nine different songs, seven of which Yash Raj Films claimed they had a copyright over. The court applied the doctrine and rejected Yash Raj Films’ claims of copyright infringement. It stated that β€œWe cannot separate from the life of the performer her performances” and that in the setting of a chat show β€œas long as the singing duration is limited to a minute or so at a time, it would be a case of de minimis use, and hence the appropriation of the lyrics would not constitute an actionable violation of the copyright in the sound recording.

Sovereignty in India vests with the People of India that is the source of Power or the ultimate authority in India However legal sovereignty vests in Constituion and we have a Doctrine called Basic structure and a representative democracy.

Keeping in mind all the aforementioned principles answer the following.

Can a 100% Majority in Parliament both the houses and the 100% Ratification by states amendment the basic structure of the constitution and would that be legal? or a 5 Judge bench can overrule it
