On May 21st, US Senator Marco Rubio announced a "high possibility" of sanctions against Brazilian Supreme Court Justice Alexandre de Moraes. The claim, backed by Republican Congressman Cory Mills, argues that Brazil’s Supreme Court is persecuting the opposition, journalists, and ordinary citizens. The current focus is on what they call the "imminent politically motivated arrest of former President Bolsonaro."
The sanctions could be enacted under the Magnitsky Act, a US law that allows penalties against individuals involved in corruption or severe human rights violations. Experts confirm the threat is real, although the process requires Congressional approval and final authorization from President Donald Trump, following his recent return to office.
Sanctions might include asset freezes, bank account blocks, visa cancellation, and entry bans into the US. While legal experts suggest the practical impact is minor and mostly symbolic, the political consequences could be significant, reinforcing narratives portraying Moraes as authoritarian.
Bolsonaro’s son, Eduardo Bolsonaro, currently staying in the US amid legal risks in Brazil, is actively lobbying for these sanctions. His efforts aim to strengthen ties between the Brazilian far-right and Trump’s administration. Meanwhile, Brazil's left-wing leaders push for Eduardo’s preventive arrest to protect judicial independence.
In the end, experts suggest this move is more about political signaling than tangible diplomatic pressure.
