✍🏻 TDS update - Section 197A for July21 and Nov21
Exam in Year 2021
Assessment Year 2021-22
👉 Non deduction of TDS on submission of declaration by deductee (payee) to deductor (payer) - Form 15H by senior citizen payee & Form 15G for others.
👉 PAN of deductee is must for above declaration
👉 TDS rate will be NIL (and not lower rate) in this section due to declaration
👉 SATC - Section 197A is applicable on payment under Section 192A, 193, 194, 194A, 194D, 194DA, 194EE, 194-I, 194K (9 sections only).
👉 Not applicable on Section 192, 194C, 194H, 194J etc
👉 2 conditions (SATC) - If payment doesn't exceeds basic exemption limit AND tax of estimated Total income is NIL then declaration can be submitted by payee.
👉 In case of senior citizen payee - only one condition
(Tax on estimated TI is NIL)
👉 No Need To Approach Assessing Officer Under This Section.
Example-
Rent of Rs. 480,000 is Payable By A Ltd. To Mr. A (62 years).
In This Case, Section 194-I is Applicable As Rent Exceeds 240,000.
But there will be no TDS u/s 197A if Mr. A submits declaration in Form 15H (with his PAN) to A Ltd. that his tax liability on estimated total income is NIL. (Reason - he has only income from rent which is only 480,000. Tax after rebate will be NIL in this case).
