The right to silence is a vital right of the accused recognised by the law ( section 313 of CrPC ).
It germinates from the right to protection against self - incrimination ( a fundamental right under Article 20(3) )
Even in NANDINI SATHPATHY CASE, the SC said that Article 20(3) is a human article which guarantees dignity and integrity to an individual and gives him the right of silence .
However , this right is "controversial " in light of the recent case of Prahlad Vs State of Rajasthan ( popularly known as the "Prahlad Dilemma" )
In Prahlad case, the SC prosecuted the accused by drawing adverse inferences from the silence of the accused .
There are other cases like Ramnaresh Vs state of chattisgarh : Munish Mubar Vs state of Haryana ; Brajendra Singh Vs state of MP, where the courts have said the the practice of drawing adverse inferences from silence of accused and prosecuting them guilty , can de done under certain circumstances.
Therefore , we can conclude that the Right to silence under article 20(3) is NOT absolute .
