First of all,
the work of legislature & executive is to make laws/regulations......And the work of judiciary is to "interprete" laws made by legislature.....but.....๐๐๐๐
Judicial activism means - the judiciary "interfering" into the work of legislature & executive...
For eg - Today , ARTICLE 21 has become wide with lot of judicial interpretations like right to privacy ( puttuswamy case), right to passive euthanasia ( Aruna Shanubag case ) , kasinath mahajan case ( ST/SC act ), Menaka Gandhi case ( expanding the scope of article 21 itself by including "due process of law " ) and may more ........in all these cases , the judiciary did the work of the legislature........( Judicial activism)
But in judicial restraint, the courts restrain itself from entering into the law making ambit of the legislature......
For ex - SR BOMMAI CASE ----- THE SC only gave guidelines related to the use of Article 356 ( president rule ); the SC didn't change the law ( here it's the constitutional law of article 356 ) , as it did in article 21 by adding lots of other rights ......
