Did you know that there is no law regulating abortion in Canada?
In 1988, in a decision involving abortion doctor Henry Morgentaler, the Supreme Court of Canada declared existing abortion provisions in the Criminal Code were unconstitutional. It did not however, declare a constitutional right to abortion either.
Because of this legal void, there is no legal obstacles in Canada to have an abortion at any stage during pregnancyโincluding up to minutes before a child is born.
Abortion in Canada is legal at all stages of pregnancy, regardless of the reason, and is publicly funded as a medical procedure under the combined effects of the federal Canada Health Act and provincial health-care systems.
All other civilized countriesโincluding all the โprogressiveโ countries of Europeโhave laws determining when a fetus should be protected as a person, and when and in what circumstances abortion should therefore be restricted. Most nations around the world that allow abortion have restrictions starting in the second trimester, and ban late-term abortions and ban sex-selective abortionsโalmost exclusively abortions of little girls by immigrant parents coming from cultures where boys are favouredโbut this is all legal in Canada.
