Are Carpark ANPR #PCN fines illegal?
There is a huge debate going on in the Houses of Parliament currently about the huge fines being handed out by private parking tickets.

Since occupiers of land are no longer allowed to clamp on Private land, many have resorted to hiring Private Parking Companies to "fine" people for parking on their land.
They cannot really hand out FINES as this would be illegal under the Bill of Rights 1688/89, so they call them "Parking Charge Notices" or PCN's.

These are enforced under CONTRACT law and when you drive onto a carpark with signs clearly posted around the carpark, apparently you have read the notices and agree to the terms and conditions! So if you didn't enter into the contract in the first place, you cannot be charged for breaching the "implied" contract.

WOIRA otherwise known as ROIRA is a tool.
The police use them and Council's so they are effective.

What is does is cut out the step of you formally asking the person to leave. So if they have no warrant, they are already a trespasser when they step on the property. If they obstruct you, that then makes them guilty of a criminal offence of aggravated trespass.

You can only sue for trespass for losses suffered, so often a bailiff will ignore the notice, but not cause any loss.

This is common in Council Tax cases where there is NO WARRANT or LIABILITY ORDER. (so it is always important to ask to see the order and take a picture of it for evidence!).

Video them and if they obstruct or assault you, it is then criminal, not just a civil matter.

What Happens if I stop paying?

There is a set procedure for when Council Tax is not paid.

First of all they issue a FAKE summons, then whether you attend or not they issue a FAKE Liability Order.

The FAKE court does not operate under either Civil Procedure Rules or Criminal Procedure Rules, it operates solely under The Local Government Finance Act 1992, which is obviously not a set of rules for a REAL court

It must however be remembered that before a summons or warrant is issued the information must be laid before a magistrate and he must go through the judicial exercise of deciding whether a summons or warrant ought to be issued or not.

If a magistrate authorises the issue of a summons without having applied his mind to the information he is guilty dereliction of duty and if any particular Justices clerks office a practices goes on of summonses being issued without information being laid before the magistrate at all, then a very serious instance of maladministration arises which should have the attention of the authorities without delay.

Many dishonest bailiffs will try to IGNORE the fact that someone is vulnerable, so it is important to notify them in WRITING to their HEAD OFFICE by Email and Letter.

You should also notify
the Creditor.
Council or Court that has instructed the Bailiff.

Disregard any objections from the Bailiff, you are simply notifying them.

After notifying them, only communicate with the Creditor, Council or Court.

Bailiffs can only call between the hours of 6am and 9pm
